Got offer of £750 today from TSB, claimed £4550, what do I do?
Can i take it as part payment as not asked to accept it, it is final payment?
Do i persue it?
Have contacted FO.
Any advice appreciated.

My bank is supposed to be sending a cheque for £1700, my claim is for £3200 and i want it all.
I have a court date set, can i accept the £1700 and then carry on for the remaining £1500 at court or do i just send it back with a polite letter saying stuff you i want it all / more?

Amount claimed: £792.50 (£898.87 with interest if settlement not reached)
Amount won/offered: £674.00
I wrote to first direct demanding a refund of the total charges on my account of over £700. They wrote back within 2-weeks offering £672 as full and final settlement BUT to be paid to Metropolitan Collection Services as my account with them went bad two years ago (their charges had a lot to do with that). But I guess it is still a victory of sorts.
I've rejected their offer on the grounds that if it is just to go to a third party then I wil take them to Court to maximise the amount they will credit to Metropolitan Collection once interest is added on.
They won't send me copy statements of my Visa account though.0 -
Capital One will do everything they can to avoid paying what is rightfully yours. I am having personal dealings with them at the moment and they are flouting the law quite deliberately in my case. They wont get away with it but be aware that they do try.
A settlement was either accepted as full and final or it wasnt. You need to read up as much as you can to fight this action and I have seen something similair happen in the Capital One thread on this site. I'd advise to take a look through the thread for ideas on how to proceed as it may get really complicated knowing how they operate.

The problem is that the debt with Cap 1 was sold on to NCO. Cap 1 say that although the settlement was in full and final settlement it was with NCO which still left a balance with them. They (Cap 1) say they are not chasing the balance and the a/c is closed. Any refunds I get are going to be put against their balance. They have already put £66 against that balance. If I go all the way with Cap 1 I will still have a balance according to them, although it will have been reduced. They say that the full and final settlement with NCO still means that my credit file will say "partial" settlement. Just not sure if its worth continuing if it wont clear the blanace anyway. However....I have signed up with Credit Expert for my Experian credit report so I'll have a look at that and see whats showing. I have to say that I thought once I'd paid NCO that was it.

Like I said the settlement they accepted from NCO was either full and final or it wasnt. You can be sure that if the situation was reversed, and they owed you money such as in the refund of unlawful charges perhaps :rolleyes: , that they would fight tooth and nail against you claiming anything more after accepting a full and final settlement.
They cant have it both ways. I've seen something similair in the Cap One thread but havent followed it to any conclusion so you may find something to help you in particular there.
If it was me I would get everything in writing from NCO and Capital One regarding the terms of the settlement and hand the conflicting information to the Financial Ombudsman to decide upon. Good luck with it and I hope you can move on to reclaim the rest of the charges for yourself.0 -

I claimed £558.33 including interest from Halifax. They sent standard letter refusing....I said not acceptable and they sent letter offering goodwill gesture of £1383.00 which will be credited to my account within 14 days!!! Fantastic!!!...but why...and will they ask for it back?

have just got list of charges back from abbey after sending them request and ten pounds but have only sent me charges up to april 2006 and i feel i have had many in the last year any suggestions as to where to go from here0
