  • Hi can someone point me in the right direction. I have a claim in against Lloyds for £1900. After 3 letters where I got no reply I have just received a letter saying £750 is to be paid to me in full and final settlement. Whats the next step do I keep the money but put in a court claim for the rest, do I go to the fso for the remainder, do I send their money back. I dont intend to settle but wanted to try to avoid court because of all the risks. Advice would be really helpful. Cheers:confused:

    As I said before the bank has offered me £1633 inc 120 court cost.They said (This is a new one to me)this is what the OFT had worked out . They worked it out that if the charge had been £12 which they deemed was fair then that would be the total amount.And they also said that they would only charge me £12 for any other refused DD.They also said that if I accept they will keep my account open if not, they will close it.

    Write back to them and tell them that you will accept the £750 payment as 'part payment to your claim without prejudice' and you will be continuing your claim for the rest of the money owed to you.

    You can go down either route, the court or the ombudsman, if you dont want to go down the court route then fill out the claim for the omdusman and claim the remainder that way.

  • Hello all, i have recently started to try and claim back £1400 of charges from the co-operative bank. I got the lidst of bank charges back in around 40 days, but to be fair they didn't charge me for this info. So then i sent the phase two letter off, i had a proforma respoce back saying that they would look into it but it would tak at leas 4 weeks. Has anyone attempted to claim back from the co-operative bank? Is this proforma letter as unpromising as it sounds?

    It will be one of the standard letters, all the banks have them and they all state they will investigate by a certain amount of weeks, usually 6-8 !!

    Stick to your timescales press onto the next step once their time is up, don't wait for the banks else you'll be waiting forever ;)

    I need some help please!

    We have tried to claim from Barclays for the bank charges.

    Husbands sole account (sent 1st week of April):
    Claimed: £195 + 37.20 interest
    Paid out: £192 - accepted: result!

    Joint account (sent 29th March):
    Claimed: 1220
    Paid out: zero but have offered £792

    My sole account (sent 29th March):
    Claimed: £530 + 84.85 interest
    Paid out: zero, haven't actually acknowledged letter although have chased!

    What I don't understand is that they have paid out, without any further question, my husband's charges (without the interest) but have only offered £792 which equates to just short of 65% of the costs (exc interest). When I rang to query why this was (as they had paid out 100% of my husband's costs AND to query why I hadn't heard anything on my sole account I was told that someone would be in contact. To date I have received confirmation from Barclays that £792 is the max they will offer and basically "see you in court" and STILL nothing on my own account.

    Not sure what to do now, please can someone help!!

Phone this morning and was told that I was on the ringback list but it was only put on it on 15/5/07 so expect a call tomorrow... 20 mins later recieved call from hsbc to discuss claim, told him i was not happy with offer and that the £85 of charges that they said I had been paid back I had not, he rechecked it for me there and then and apologised and said they had made a mistake, then offered me £3000, asked for £3300 and he said he could go no higher then £3000 as they will not pay out more then 90% of a claim, I said come on this is a negotiation and said i would be happy to settle at £3150, he said i bet you would, then said ok and he will get the offer out in the post today and expect to recieve it in 2 or 3 days.... I make that about 94%

    Seems HSBC are making a offer after 8 weeks, but if it goes to the court stage then they get their hard heads on and see it through for as long as they can.....

    Will post on the success thread when monies safely in my account....

    I wonder if you can help me with this question please.

    A lady friend has made a claim on HSBC and she has included all the penalty charges plus the monthly Bank charges for the years 2004 & 2005.
    Can she claim back the monthly Bank charges?

    She has not got a copy of HSBC Bank charges for those two years. Did they cahrge for services? And how can I find out what the charges were?

    Started in May 2007, I wrote the first letter asking for the charges and rec'vd the standard 'we think they are fair so just go away letter' followed this up with the 2nd letter threatening court action and they paid up almost immeadiatley! :T The money went straight into my account.

    Currently pursuing our joint account also with Lloyds bank for nearly £7,000. Also attempting to claim from Capital One and Vanquis Bank for their credit card charges.

    I have also been helping my sister reclaim £455.00 from Halifax bank, I have written two letters from her and she has rec'vd a letter offering £500 in full and final settlement - more than we had asked for. :rotfl:

    How are you getting on with Vanquis? I could not find my details as it is an old card. So I emailed their site and asked for statements to be sent to me or information enabling me to claim. They sent a letter sayng here is an offer amounting to the amount you claim are the total for charges. I am confused. I have not had statements and have not given them any figures - as yet. How about you? SOund familiar?

    The smaller the amount the less they want to spend! It's not cost affective to mess about with small amounts, thats why I got paid out over the odds with my IKEA Card.

    The banks know you are right and they are in the wrong but want to try and bluff you into accepting less. I would write to them and point out they have paid out in full on the other account, this will make them look bad when you take it to court and have to present all your correspondence to the judge ;) but they will probably just write back saying each claim is different and judged on its own merits, this is not true as we are all claiming under the same circumstances and for the same reason but the bank are just trying to bluff it again!

    The banks are playing a game of 'poker' with your money and you have the better hand. Don't fold early and let them win your money!

    It sounds like a service charge, which can't be claimed. I pay £14.50 a month service charge that cover my overdraft facility plus quite a few other benefits. The only charges you can claim are the penalty ones.
