If they feel that "IN THE BEST INTEREST OF BARCLAYS NOT TO GO TO TRIAL", they will refund you £4,582.83 then $570 is certainly not in their interests
so you'll get it back
I guess what happened in Hull has shaken their bones a bit
I cannot begin to tell you how chuffed I am. I have now spoken to the solicitor in charge, who has re-issued the letter (scanned in and emailed) and added the clause "This settlement does not infringe your right to issue any future claim regarding charges incurred since the court issue date". He cannot authorise the refund of the additional charges, but I am happy that I can go to whoever can. Money should be in my account by Tuesday. Happy days! :j

Keep at it folks - I was one of the constant worriers that it would be me - you know - the first to go the distance and be rejected. Many, many thanks to everyone on here. I wish I could buy you all a :beer: , but I would probably be overdrawn again.
P.S. My court date was to have been the 16th July, so timewise it seems to fit in with other experiences. Also, I am ringing them today to accept, but also ask for my charges from submitting my claim to now, which amount to a further £570. I had asked for these in my court bundle, but no mention in my letter yesterday. After all, they are equally unlawful, and it is my money! If not, then I will just start the process again for this amount.
Hubby next - he's about 4 weeks behind me.

A branch of the Abbey bank has been given until next Tuesday to repay £2,769 to a customer, or face having its equipment seized by court bailiffs.

When you read the article, go to the bottom of the page and you'll see this.
"In January, a London man, Declan Purcell, sent bailiffs to a branch of the Royal Bank of Scotland in Camden Town after winning a court order for the return of £3,400 in overdraft charges.

Have just received a letter this morning from NATWEST:mad: saying that if my husband does'nt pay in £93.00 he is going to be issued with a default.
He has already withdrawn all banking arrangements with this bank after sending 1st letter reclaiming £350.00 last week. The £93.00 has since been added in yet more charges.
It also states that if he does'nt return card and cheque book to collections centre in Birmingham, Recovery Agents will be instructed to collect the cards which will result in a fee of £125.00 being charged to his account. :mad:
We have returned the card and cheque book this morning with a note explaining that as soon as reclaim charges are received by him he will pay in the £93.00 immediately.
Was this the right thing to do ????????
Am getting a bit worried by all the big words in the letters from the banks...0 -

BLATANT INTIMIDATION BY NATWEST
You must report this to the OFT IMMEDIATELY
You must not put up with this rubbish. In this case, I personally would get the media involved. This is a story they will pick up on. Let the media ask Natwest how they calculate their charges and tell the media that Natwest are trying to blacken your good name for charges they will not explain.
CREATE THE EXPLOSION QUICKLY BECAUSE NATWEST CANNOT BE ALLOWED TO CONTINUE IN THIS DISGUSTING MANNER.

Unfortunately quite a bit of what I have got is going straight back to them, but to clear my overdraft will be fantastic - and then a bit left over for my holidays.

Thank you. I downloaded your templates a few months back but I was claiming too much for small claims court. Spoke to Financial Ombudsman Service who said they can pursue much larger claims. One letter from them and another from me and I was offered the full amount last week, which I accepted and three days later it was in my account.

Well done!! I am trying to claim thru the FO, and mine for a large amount £10k all but a few quid! I'm having serious doubts now, & starting to think I'll get nowhere etc etc. The only letter i've had was from the 20th June saying it was being passed forward to the investigation team & nothing since!! Am I being impatient? I really need some good news! How long did it take your claim.

i have been going through the reclaim process with HSBC for £139.00 over 2 accounts one account owing £59.00 the other £80.00, my first letter sent dated 10th april 2007, i have finally received offers of refunds on both accounts the first they have offered me the full £59.00 which is fine and i have obviously accepted, the second they have offered me £25.00, the reason being that £55.00 of the £80.00 they say is out of date, the first 2 claims of £27.50 each were on 21 april and 21 may of 2001 which is 6 years ago, based on my original letter dated 10 april 2007 these claims are in date, however HSBC seem to be basing the six year rule on the date that they finally sent an offer through being 26 june 2007, stating that this offer is in relation to all charges placed on my account upto and including 22 june 2007(although my claim was posted in april) my question is when does the six years end, when i first claimed or when they decided to pay out?, is this just a way of getting out of paying the full amount?0

I wrote to Lloyds TSB claiming £1711.31 with interest which was £1505.00 before interest after 2 refusals to pay anything and me threatening court action on 22/05/07 they put £750.00 into my account which I have used to clear some of my debts but I also wrote saying that as it was less than 50% of my claim without interest I wasn't happy and was going to pursue court action but would accept £1200.00 as a settlement. I have since received another letter refusing any further settlement, do I go for court action or do I walk away pleased that I got something0

My boyf has received a letter from LLoyds TSB solictors saying the bank will be defending as - the fees are properly incorporated into the contract with the bank and by making payments by cheque, debit card etc and going over the overdraft there are penalties as it is breach of contract blah blah yada yada.
However, they are asking him to telephone LLoyds TSB within the next 14 days to reveiw his account and they expect confirmation from the bank that this action as been taken.
I haven't heard about people getting this letter - can anyone shed any light?
