Hi
I am sorry to start a new thread, but I am still unsure of what to do despite reading loads of stuff on here and visiting the POPLA website! I visited 'Toys r us' with my little boy and my husband came to pick us up in the car. We haven't visited the Peel Centre for quite a while and knew it as a pay and display car park. As he was only sat in the car reading and waiting for us to come out of Toys R Us he didn't bother to get a pay and display ticket. We received a £100 fine in the post (reduced to £60 if paid promptly) about a week later as his car had been captured on their cameras (photos printed on his "parking charge notice"). My husband didn't get out of the car at all at any point. Some of the threads on this forum say to ignore the correspondence and some say to appeal - I just don't know what to do and I am so upset about it. £60 or £100 is a lot of money, but it is the being made to feel like a criminal or worse being exploited and ripped off by these sharks!!! I've been waking up thinking about it all week as I am so worried about balliffs and courts! If I should appeal - on what grounds? What would I put in the letter? Please help me in what to do next........thanks.:(

What is it about all the other threads and replies you do not understand? Have your circumstances not been covered?0
-
If you have read "loads of stuff", then you will know all the advice. I know it is worrying, but your case is no different from others.
Repeating it again won't change it.
Just follow the general advice and stop worrying.0 -
Please don't worry. It's not a fine. Only the authorities can fine you not private companies. Did you read & watch this piece on BBC Watchdog? http://www.bbc.co.uk/blogs/watchdog/2012/04/excel_parking.html0

I am new on here and I didn't say that I had read ALL the other threads. I started my thread with an apology. I was hoping that someone would help me as I am finding the wealth of threads confusing. I am sorry that you felt you had to put this.0 -
I would say ignore this ticket in this case, I just can't see popla going in favour of you as you didn't pay, they just look at specific things like contract, they will say you breached it and so will find for excel IMO .
It's highly unlikely it will go to court as excel hardly ever go there, and no bailiffs will turn up because first it would have to go the small claims, you lose the case, not pay within 28 days and then they go back to court to pay for court appointed bailiffs. I have never heard of excel doing that ever !
If you ignore you'll get a series of letters with increasing levels of absurd outlandish threats, none of which really happens. IMO you should keep your head down and ignore the letters. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Didn't mean it to sound harsh, sorry. Just that as you were worried, by reading the other threads you would have found lots of valuable info and that you were one of a large number of victims, all in the same boat. You said you had read lots of stuff, so was wondering just what else you could have needed.
Nothing unique, as it were, in your particular circumstances. So, as advised by a couple of people, just ignore for time being.0 -
Narrow the threads you read down maybe, by using the search facility? That should help you see the wood through the trees!
Put a keyword like 'POPLA' or 'Peel' or 'Excel' (but not all 3 at once and make sure they have appropriate capital initials) into the 'search this forum' box and change the search from the default 'show threads' to 'show posts' instead - which I find is much better for narrowing down certain information to suit the keyword.
The 'search this forum' box is on the main forum above the posts, on the right, but do change the default as I suggested when you use it each time:
http://forums.moneysavingexpert.com/forumdisplay.php?f=163
I would also suggest you just read the current threads under those marked as 'sticky' threads. Just read those with replies today about ANY private parking company. You will see everyone asking your questions and the advice is the same again and again, which is why we do get a bit bored replying sometimes...!
Either ignore the whole scam (tick off the scary letters one by one in the archive pics here) or appeal the stupid thing and do some homework about how to word a POPLA appeal and win it, ready for the rejection letter. Do whichever of those choices suits you best! DO NOT PAY, ONLY IDIOTS PAY.
If you prefer to challenge (rather than do nothing) then here's a template challenge letter you can use some or all of, download here:
http://www.parkingcowboys.co.uk/appeal-letter/
You will notice it is deliberately worded to tie a PPC up in knots with LOADS of legal challenge points and demands for evidence. No info given away at all about what happened on the day, no begging them to cancel it, certainly no 'sorry it was my fault' nor even any info telling them who was driving.
There will be NO COURT nor CCJ nor bailiffs and you will not get any bother about this scam fake PCN if you choose the ignore option, people have been ignoring Excel for flippin' YEARS! Here's a thread to put your mind at rest and stop you from worrying about bailiffs and Court (will not happen, it's just like ignoring phishing emails!):
http://forums.pepipoo.com/index.php?showtopic=24362
Please calm down and stop losing sleep over this 'fake PCN' con which has been covered on Watchdog and which EVERYONE here has ignored (me included).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

lets get this right,,firstly you get a FAKE ticket on my patch ,without my permission, secondly you believe it is real?i was there yesterday afternoon preaching to the unsuspecting motorist about the SCUM known as excel parking and their FAKE tickets,so lets end it here,IGNORE,because you have a PARKING charge notice=fake/con/scam/fiddle/not enforceable=loo paper,,,a real ticket is called aPENALTY charge notice=must be paid,,,,so there you have it jobs a real belter,,as nothing can/will happen if you ignore,,,though you can go down popla route that is up to you,, i have a drawer full of loo paper from the SCUM excell and follow up threat o grams from ,,wait for it ,, on the next desk along,,oh yes,, roxburghe (we have zero powers )debt collectors,, and then from the desk in the corner,,little janis on work experience puts threat o grams/loo paper in the envelope as,,graham ( i am a phoney solicitor)white,,this time the threats get worse(everything but the firing squad) and the red ink gets thicker,,guess what ,, IGNORE,,,in conclusion, very posh aint i,,please be aware of same scam in aldi car park on newbridge lane and in b&m immediately opp peel centre,do not respond to any pm,,s sent to you with a low post count, as the SCUM/COWARDS excel check this forum daily and like on occasions to mislead our congregation with pretend(just like their tickets) advice/information,so please now relax, chill, feet up, worry not.0

You must ignore anything you receive from Excel (cowboys). Also you must spread the word to family friends and anyone who will listen. I've saved a few of them.
I have recently had my 3rd piece of toilet paper off Excel, I parked in the carpark one night to got to Frankie and Bennys. I actually thought it was free at this time as its empty anyway but received my piece of toilet paper through the post a week later. This one will be ignored as the previous 2 were, never reply to them or they know there is someone worried at the other end! With the previous ones I received about 6 letters which got progressively more and more threatening untill they realised I couldn't give a s**t and they eventually gave up!
Just bin any letter you receive and take joy in the fact that you have cost them money in them buying your details off the DVLA who frankly should not be giving your personal data out to such scum!0 -

Rest of advice isn't bad, but DO NOT bin any correspondence. File it instead.
Reason? Some of these PPCs are starting to issue court papers. Still very unlikely you will get some, but it's more likely than last year as they have to keep money rolling in and clamping is banned, and, of course, Martin, Watchdog et al are spreading the word. T
There is no downside to keeping the paperwork, but there could be an upside.0
