    However, the email address is [EMAIL="which@which.co.uk"]which@which.co.uk[/EMAIL] if you email independently saying that you have evidence that T-Mobile has breached its T&C and copy in the letter you received that may help - in fact if all 8,000 people following this thread could email [EMAIL="which@which.co.uk"]which@which.co.uk[/EMAIL] with the email title "T-Mobile in Breach of own T&Cs" it may grab their attention and push the matter to the front of the queue!

    On sending the email you will receive an "auto response" email, it took 10 days before I received a personal response.

    Im struggling to get any reply from tmobile! No reply to emails, no reply to letters. Next step is a letter before action.

    I think CISAS should come before LBA.

    Remember T-Mobile pay for every case CISAS take on, it's going to get to the point the cost of defending at CISAS will be higher than allowing the customer to make use of their right to cancel.

    I think I may have just found a "smoking gun"!

    Look back at post #62 by Tr26 in this tread. Tr26 says he(?) has a letter from T-Mobile that informs him they have used Januarys RPI published in February.

    Tr26 can you copy the letter into a fresh post including who sent the letter?

    Has anybody else following this forum received a letter that says T-Mobile used Januarys RPI?

    If we can pool the various letters/emails we have we can prove what we already know - T-Mobile are making things up as they are going along. This will make our court cases (should T-Mobile be stupid enough to go that far) even easier!

    Here's the email i had from them, dated April 11th. I replied but haven't had anything back since.


    "Thank you for your recent email relating to the recently announced change in pricing structure. I have been asked by Olaf Swantee to respond on his behalf.

    The frustration you may have felt at our recent announcement regarding a change in our pricing policy is acknowledged. This is a decision we have not taken lightly. We are continually investing in our network and propositions to provide the best service possible for our customers. Our network has recently undergone a major overhaul with a full upgrade of our 2G network masts. This will ensure that there will be less chance of calls dropping out on our network and text messages being delivered more efficiently. The integration of the T-Mobile with the Orange network will also greater UK wide coverage for our customers.

    The increase is in line with the Retail Price Index 3.3% rate of inflation released on 12 February 2013. The increase applies to your monthly fee only. Individual call, data and text message charges remain the same.

    This increase would not allow you to cancel your agreement at this stage without paying an early disconnection fee. Given the size of the increase we do not consider this change to be of material detriment to our customers. We are happy to discuss individual cases to see if there is a price plan that is more suitable.

    All - please correct/update if I get anything wrong below, but I think what we now have collectively is the following:
    1. February 12 (?) - ONS release Jan RPI 3.33%
    2. March 1st - T-Mobile announce Price rise of 3.3% in press
    3. March 19th - ONS release Feb RPI 3.2%
    4. April 5-8 - T-Mobile write to customers informing of a 3.3% rise due to CURRENT RPI
    5. April 6 onwards - Customers point out T-Mobile in Breach
    6. April 6 - April 18 - T-Mobile Customer services say rate is based on January and claim no breach
    7. April 11 - Tr26 receives email confirmation from T-Mobile that Jan RPI used
    8. April 16 - ONS release March RPI data 3.3%
    9. April 18 RandomCurve informed that T-Mobile legal time are investigating the letter and T&Cs and won't comment on price queries until investigation complete.
    10. April 19 - T-Mobile beginning to send letters to customers explaining they used March figure' and why they believe they are entitled to use it.

    No doubt T-Mobile will begin to offer customers who call and complain to cancel the increase or offer a small reduction -but remember this, you could cancel and go elsewhere on a SIM only deal, so if you are tempted to stay first find out what a sim only deal will cost you and tell T-Mobile they need to UNDERCUT that deal otherwise there is no incentive for you to stay with them!!!
    Alternatively you could cancel - sell your phone to one of the many companies that will pay good money - and get a nice new shinny one for the same price as you are paying now - and have some cash in your pocket!

    Also I believe our right to cancel stems from the fact that they have written to tell us of the price rise, and is not dependant on the price rise actually happening - so if they think they can stop us from terminating by cancelling the price rise - they are WRONG. :rotfl:

    Agreed, including your last point.

    At the moment T-Mobile increased by above RPI and the customer informed them to cancel there is no contract left, they cannot try and renegotiate on a contract that was voided by the increase.

  • Am I missing something?

    If the RPI for the year 1/4/12 - 31/3/13 is 3.3% overall, then regardless of when that figure was actually published, doesn't it mean they 'got lucky' so to speak?

    Am a bit confused!

    I agree, they would have to honour all notices to cancel between written notice being sent and any u-turn on the price rise, otherwise it's still breach of contract.

    I'm now convinced that a u-turn is their only real option, especially after reading this interesting article earlier

    Tmobile are increasing prices by 3.3% and this is higher than May, June, July, Aug, Sept, Oct, Nov, Dec 2012 and Feb 2013. T-mobiles price increase is higher than not just any, it is higher in actual fact than 7 of the 12 months in the previous year.
    To my thinking the highest they can increase the prices now is 2.599% which is not higher than the lowest figure(Sept2012 2.6%) in the previous 12 months. If they meant for just the 12 month figure the month prior to their intended price increase I think they would need to replace the word 'any' with 'the'. i.e.

    'an increase in Your Price Plan Charge (as a percentage) higher than the
    increase in the Retail Price Index (also calculated
    as a percentage) for the 12 months before the
    month in which We send You Written Notice'

    I think this would make more sense and is what was perhaps intended as it would allow a company to increase its prices but only to the lower limit of the price index figures. Also explains why they changed their t&c's to say the month closest to the change!!

    Here is perhaps a better explanation(the lowest level of RPI in the prevailing 12-month period)

    The aim is to goto CISAS, but tmobile dont seem to want to give me a deadlock letter! May be a case of waiting another 6 weeks.
