    "CISAS (the independent adjudicator appointed by Ofcom) is consistently ruling that the price rise applied by T-Mobile referred to the wrong months RPI figure and was therefore higher than allowed under its contracts. Despite 2 million customers being affected Ofcom refuse to step in and protect the consumer. Can you investigate?"

    Or words to that effect.

    well 7th of august deadline is here, still no refund, have just raised another claim this time for £100 compensation for failing to meet the deadline, rather enjoying this:) weather i suceed or not remains to be seen, but either way its nice to know the balls in my court, rather than tmobiles

    Done, and got a bit carried away. Here's what I put:

    Mid-term price rises of "fixed" mobile phone contracts are currently under investigation by OFCOM. Hopefully they will side with the Consumer and ban them as they are seldom high-lighted at the point of sale by the provider and hidden away deep within a contract that the Consumer seldom reads fully before purchasing.

    The recent T-Mobile price rise of 3.3% (from 09.05.2013) is a perfect example of the provider riding rough-shod over their Customers and OFCOM not only standing by inactive, but complicit in dissuading the Customer from taking the action available to them to cancel their contract without penalty.

    A summary of this is that T-Mobile increased the costs of their Customers existing contracts by more than the OFCOM guidelines and their own T&C's allow. When Customers complained, T-Mobile played very loose with the truth and at times actually lied to their Customers to deter them from taking the complaint further.

    Contrary to the OFCOM guidelines they also denied Customers the Right to seek arbitration through the CISAS alternative dispute resolution service.

    Those Customers that were resolute in their determination to right the wrong of T-Mobile and were willing to spend upwards of 18 weeks fighting their claim and getting it through the Arbitration process found a service with CISAS that was eventually very open to the Customers view and has consistently found in favor of the Customer, forcing T-Mobile to allow those Customers penalty free cancellations and in many cases back-dated to the start of the claim, as well as compensation for the "significant breach of contract".

    OFCOM however inadvertently supported T-Mobile, likely significantly reducing the number of customers willing to take their complaints to Arbitration. At a prime time during the dispute OFCOM publicly stated they had reviewed T-Mobiles actions in relation to the price rise and felt it was fair. A statement that has now proved to be substantially incorrect.

    It is also apparent that T-Mobile have mislead OFCOM in the way that they have dealt with their Customers, with contradicting evidence supplied to OFCOM by some of the Customers involved. However, it seems OFCOM are currently inactive with regards to investigating this deceit or taking steps to penalise T-Mobile's behavior.

    With several million T-Mobile customers effected by a price rise that OFCOM Guidelines state should allow those Customers to cancel their contract penalty free, but only a relatively small number of Customers obtaining the redress available due to the hurdles placed in their way, along with incorrect Public Statements by OFCOM, I feel OFCOM should be investigated further for their complicity and inactivity in this matter.

    Following on, I feel it is evident that the Consumer requires protection from mid-term price rises since it is clear that OFCOM are unable to insure the provider act fairly to their Customers in its relation.

    I have also received a succesful response to my pre Oct contract, backdated to 8th April full refund and £100 compensation So 29-2 to the consumer
