    I said before when this happened to Random Curve, it's a ploy that they hope will go unnoticed by the adjudicator (nothing against the adjudicators, they simply have a mountain of evidence to trawl through and things can get overlooked). You have to spell it out very plainly in your comments back, point them to ALL the documentation that shows you're on v59. If you haven't done so already, I'd submit a screen print of this, which clearly shows when v59 came into effect:

    Their attempt to play on the complexity of the legal interpretation is laughable and a wee bit desperate, given that the CISAS adjudicators have all commented in their findings that it's not a complicated point of law (and it's actually quite insulting to the adjudicator).

    IMHO cancelling the direct debit is a very good idea to ensure T-Mobile don't take the money. You can then still pay your regular bills or any bits that aren't in dispute online (without charge) and dispute the remainder.

    Unless I have missed a very good reason then advice not to cancel the DD is bad advice IMHO.

    Go for it ruflonger, one win at SCC, and two trips down the CISAS route, you'll probably have cost TM more over this than any other individual customer ;)

    I believe I will also ask T-Mobile what my termination charge would be as of today. I would if it will also be a higher amount than stated in their Cicas defence?

    I would agree with you, when they tried the ETC on my account I advised them I was in dispute and cancelled the DD, I then paid my monthly line rental by debit card over the phone as you are only supposed to withhold the disputed amount and pay the rest.

    Make sure you look at some of the previous judgements in the previous pages... you can near enough do the adjudicator's job for them by explaining that there are two different interpretations of the T&C's and when that is the case, consumer law states that the interpretation that favours the person who did not write the T&C's should be the one used....

    My CISAS adjudicator has just been appointed. A Mr Richard Stephens. Don't think I've seen his name before on the thread as being appointed adjudicator for someone else.

    Described by Chambers Guide to the Legal Profession as “good news in the most complex of cases” and a “leader in his field".

    At the very least he seems to know what he's doing!

    Will update when I hear next form them.
