    Follow the advice you've been given.

    The bit's I've highlighted you might want to point out to the HA - as the landowners they are jointly liable with their agents - it doesn't dissolve them of responsibility !!!! Therefore they CAN do something about it - what they meant to say was that they don't want to do something about it !

    I would send them a notice before claim for the harassment, a claim of £300-£500 is probably about right, send it to the HA and Wing Parking. Give them 28 days to cancel this otherwise the next step is a claim.

    Can I just say though if you do send a notice before claim , be prepared to issue against them, otherwise it will just be a threat

  • Ok, i'll give this my best shot.
    Although I have already written to the BPA and they said wings parking had done nothing wrong? But granted this was before i had asked wings parking for the verification code for POPLA.
    If I do decide to bring a harassment claim, who would it be against, wings parking or London and Quadrant?
    I'm sorry but how would I even go about it,and can you estimate how much this would cost?
    So this is my plan
    1.i write to DVLA and BPA (again)
    2.i write back to the housing association saying I wish to escalate my complaint as they should know their agents are showing a blatant disregard for their own code of practice and are now in effect harassing me without allowing me to appeal through the proper channels?
    Also I've received another letter from Debt recovery plus demanding payment albeit for a reduced, amount by the 7th October...

    Thanks to you all for your suggestions/advice, i'll brace myself for more let writing! you've restored my hope again!!! :)

    To send a notice to claim costs a stamp and envelope and that is it, to issue against them costs about £25 and some of your time, I have seen claims from a few people in the region of £300-£500.

    It's a last resort though and you should go through the process of their complaint fully. But you can give them the notice regardless of where you are in the complaints process IMO , this just says that if they fail to cancel this you will issue against them.

    Dear all

    I thought I'd let you know the latest development. So I wrote to BPA, who investigated Wings Parking and found they have done nothing wrong. In fact they state its my fault for not following Wings 2 stage appeal and for this reason Wing Parking dont have to give me POPLA code. looks like i'm going to court, as i'm still receving letters stating if I still dont pay i will be up in court. I'm wondering what to do now. Do I write to Wings Parking and say see you in court? or...

    I'm still thinking about this counter claim, but as I haven't even been through their process of complaint fully, is it a bad idea to counter claim in this instance?

    Have you replied at all times, ONLY as the registered keeper? Do Wing know who was driving? If not then they can't hold you liable at all and would not win in court if you robustly defended any claim, with points such as the fact they haven't used POFA2012, so they haven't got registered keeper liability at all.

    Or do they know who the driver was from an early appeal?

    Can we see the BPA response please?

    OP - Did Wing inform you that after the first rejection you had a right to appeal again? - Are Wings the only PPC to do this?

    IMO I would write to Wing the BPA and copy the debt recovery agency and state that you were misinformed of the appeals process stages that Wing gives and have been denied your right to appeal to POPLA. Reaffiirm what other posters have stated regarding your legal rights to park in your designated parking space on your lease - which overrides any attempts via third parties to enforce charges.
    You should also consider making a formal complaint to the OFT and Trading Standards. You could also contact the housing department at your local council are you are part renting your property and see if they can assist.

    OP - Did Wing inform you that after the first rejection you had a right to appeal again? - Are Wings the only PPC to do this?

    Is there not or at least certainly used to be a PPC where it took about 6 months to follow their internal appeals system, before you could get a POPLA code?

    Think it was a long the lines of 1st appeal, tea boy rejected, 2nd appeal, mail bot rejected, 3rd appeal, appeals guy rejected it and 4th appeal, MD rejected it.

    Wing have not initiated any claims in the 12 months to October at all, so there is very little chance of them going there unless you make a claim. Remember that the bpa are the trade body of parking companies, their first job is to protect the interests of their members, these companies fully fund the bpa.
