    No because as I've made clear it depends on the level of the crack. Some games have massive cracks in which don't work, some have a minor crack that do work.

    I would buy a £40 game for say a fiver if it had a minor crack, I would not buy it for £20 as its not worth it b

    I don't mind buying goods that are damaged as long as I can get them to work.

    What you define as "merchantable quality" is different to how I define it as I'm quite tech savvy and I don't mind doing a bit of work to get it to work.

    You can get good bargains buying damaged/broken products and fixing them yourselves.

    The condition of the disc aside, I am surprised at GAME for their attitude. My local GAME shop (used to be Gamestation) are really nice, admittedly I don't shop in there very often because I think they are overpriced, but I find the staff are very helpful. Recently I traded some PSP games in a brand new game for a gift they were really helpful. In fact they checked all the games and there was only one they wouldn't trade in as the UMD case was split which I hadn't noticed, they said they couldn't guarantee the game so they couldn't accept it.

    The only other gripe I have with them, apart from being overpriced, is the assistants do ramble on and hence you end up waiting a while at the counter. I got asked if I wanted a reward card (no because I rarely shop there and it would be no good if they go into administration again), also I got asked if I wanted to protect my new disc against damage/scratches for an extra £1.00 (what's that all about then?).

    Merchantable quality has a distinct legal definition (which is the one that I follow) and is not a matter of opinion.

    That definition is not that something is of merchantable quality if a person who believes themself to be 'technically savvy' might be able to get it to work. rolleyes.gif

    Obviously you are entitled to try it if you wish but others are not obliged to. A cracked disk is not of merchantable quality.

    I take you point, but I can't see that merely because a disk is second hand a crack is acceptable.

    However, we'll just have to agree to differ because neither of us can state a definite fact, only a court can do that.

    I wouldn't even accept a significantly scratched disc, let alone a cracked one. There's no reason to expect a second-hand disc to be marked in any way. I've sold dozens of games and have many hundreds of CDs and DVDs and not one has anything but the tiniest of scratches. 99% are in the same condition which I bought them - as new with no marks whatsoever.
  • There is no excuse for poor customer service. However why oh why do we have to make a complaint against someone so personable.

    We could.
    1) vote with our feet.
    2) Pass on our concerns without naming names
    3) try and be a bit more understanding.
    4) laugh

    My reason for this is I work customer facing and some days and with some customer I truly want to cry. Some people are so very demanding and sometime that person has just walk out and you just happen to walk in. I am not making an excuse for bad service just think some times believe me I do each time I go into a shop etc. SMILE WE ARE ONLY HERE ONCE. YOU DO NOT ALWAYS HAVE TO COMPLAIN. IT IS NOT YOUR GOD GIVEN RIGHT TO MAKE SOMEONE LIFE MORE LOUSY THAN IT ALREADY IS.
