- The guy has bought a car listed as 'no MOT' and 'for spares/repairs'.
- You've aired your concerns about it being driven to the buyer.
- The buyer has told you they are booking an MOT locally to the car.
- The buyer has advised you transportation has been arranged for the vehicle if the MOT fails.
- The buyer has advised you he will arrange insurance prior to collecting.
Based on the fact you have taken reasonable precautions and what the buyer has told you ---- even if he gets pulled I seriously don't think you have anything to worry about! So just sell the car and ask no more questions.0 -

Agreed - now that your points 3, 4 and 5 above have been established there's a pretty good case for "reasonable belief" that he won't be driving it. Whether he does or not isn't the OP's concern provided they can say they believed he wouldn't.

True, but S.75 specifies a fairly narrow definition of roadworthiness compared to the MOT test - basically tyres, steering and brakes or anything that makes its use dangerous (presumably rusting in half etc).
If it's likely to fail on a headlamp then, as long as the test is in the daytime, it's not making its use dangerous - you can get an MOT and legally drive with no lights at all fitted as long as you stick to daytime use. Similarly, wipers and washers (if it's a dry day) and things like emissions may fail an MOT but they don't pose a danger so wouldn't be grounds for a S.75 offence.0 -
maybe, but the point I'm making is that s75 doesn't depend on where or why he drives away.
If he drives away in an un-roadworthy car then the offence is complete whether he drives to a local MOT, distant MOT or anywhere else0 -
Well, the latest development is that the guy texted this evening to say that he can't get an appointment for an MOT tomorrow and is trying to get one either Sunday or Monday. Of course he is not going to be able to do this because it is a bank holiday.
Therefore, my husband is going to telephone him tomorrow to ask if he can pick the car up tomorrow bearing in mind he is not going to let him drive it away without an MOT. If he says no then he is going to say that he has had a week to collect it and therefore we want to sell it to someone else.
My husband said that the previous evening he tried to dissuade him from buying it because he is not capable of collecting it and the man asked him if he didn't want to sell it to him because he was not English. He is Pakistani or Indian we think. The truth is if he turned up with cash and a trailer we would not care if he was from the planet Mars. However, we are now worried that he is going to accuse us of being racist when it has nothing to do with it. We just want to get rid of the bloody thing off our drive without all these complications.The forest would be very silent if no birds sang except for the birds that sang the best0 -

You can drive 300 miles to an MOT station.
Unless you can provide DVLA or government website that say differently.
