Ah, forgot you had filed it with ebay. What I meant to say was that the auction had completed, and therefore as far as ebay's system was concerned, the sale was done and feedback was available. I had a sale last year which fell through for various reasons, and even though no sale took place, I was still able to leave feedback for the 'buyer' and presumable he/she could have done for me.

    Sorry, my misunderstanding.

It could get very complicated if we sell it then he pays up. I would just have to send it right back to him.

    How would he pay?

    Cheque - return it uncashed.
    Postal order - same
    Paypal - refuse/reverse the payment
    Cash in hand - refuse
Cash in the post - tricky, but also massively against ebay rules. Report him for that as well.

Unless he has your bank details, he can't pay you without your acquiescence.

I would send him a message via ebay messages (so it is recorded on the system) that as your sale with him has fallen through, you have now sold the car to another bidder and it is no longer available. Some people need telling in simple language.

I noticed there was a telephone number on the other Toyota Corolla car ad he bid on so I phoned the number. The lady said that someone of the same user name, but a lady, was the top bidder. All that happened was that they never received payment or any communication whatsoever from the bidder even though they sent lots of messages. They had no telephone number for her/him. She said they went for a second chance offer and the next person down phoned and offered them a very low amount, which they refused. (Which is what has happened to us, except that my husband has accepted it). They have now sold the car for a higher amount than the original auction. I am starting to think this is a scam.

They have an unpaid item dispute going on at the moment but there is no strike because it has not been resolved. Ebay told me if I close it after 4 days we will receive a refund of fees and he/she will receive a strike. If there are many strikes then their account can be investigated/closed. So she is going to talk to her boyfriend about it tonight. She said he should not be on Ebay. I am going to start an unpaid item dispute so he will have at least two strikes.

We are £130 down from the auction price plus my husband has thrown in the workshop manual because he wants to get rid as he has the work van now.

Does make you wonder if it is a scam and the the second chance bidders are mates of his (doubt it but u never know).

I always assumed that the person who got the second chance offer had to pay what their bid was, didnt realise they could change their bid

The second chance offer has not contacted us again so now I am imagining that he is in league with the first guy and has been frightened off. He wanted to do it unofficially with a much lower price. My husband accepted but I am now glad that he has not appeared. I am trying another second chance offer as they offered a decent amount. After 24 hours I am relisting it. Unpaid item dispute opened.

    That was my assumption, too.

I would relist it immediately, blocking the original bidder and possibly the second bidder as well, as he sounds like a bit of a chancer. Your other bidders will be informed you have relisted.

Lots of ebay listings begin 'relisted due to non-paying bidder' and the like. It's quite legitimate, and it gives you a fresh start on the whole thing.

    Good luck with it.

Well, with this second chance bidder he only has 24 hours and we will only take the buy it now price. We are fed up with people trying to con us. It would be better to sell it now because my husband can't bring his work van home until it is gone.

I do appreciate all the helpful advice by the way, from you and others.

This seems to go on and on but I have to tell you this latest development.

The lady I spoke to earlier phoned me this evening. Apparently, the second chance bidder who tried to undercut them sounded very much like our bidder. So it is possible he bid high under one name then came in with a lower bid under another name.

She told me his member name and I looked up the bid history. Guess what - lots of top bids on cars, lots of cars re-listed. So I looked up this guy's feedback and he has received a whole load of false positives about what a timewaster, jerk etc he is. I looked up the feedback he had been giving out and he has been giving negative feedback to people who he has let down and who have had to re-list their cars.

I therefore sent the following message to Ebay:

Thank you for your reply. With very limited knowledge I have researched ****** and suspect that ***** and member ****** are the same person or perhaps work together. ****** has been leaving negative feedback on people who seem to be perfectly innocent victims. I can see from his false positive feedback that these people have re-listed their vehicles after he has bid on them and not paid. I think it is shocking that this negative feedback has not been removed and their rating has been affected whilst they are unable to criticise his actions and his rating has gone up. You have informed me that there is an investigation into *****. As a regular Ebayer I think this kind of behaviour should be policed and stamped out. As I have said a person with limited knowledge and time is able to find out this information therefore I think it would be no problem for you to investigate this person or persons and remove the negative feedback on their victims. There may be other people/user names also doing this. Ebay has already got a very bad name for scammers and if you can't even avoid them by being careful, the whole site will soon lose its credibility. We all know how quickly a rock solid site can go to the wall once people start to lose confidence.

Nothing may come of it but I feel better. I will leave it now.

Are you surely you pronounced it clearly.... he might have thought you were insulting :rotfl: him?

    Sorry.... couldn't resist.... good luck!

I'm sorry to resurrect this thread. Some of you must be heartily sick of it. I have relisted the car, no Paypal, cash only, no timewasters. I have blocked as many dodgy bidders as possible. Now I have a top bidder who has a feedback of only 4 and he has been a member since the middle of March. He lives in Lancashire. I have sent him a message to point out that the car cannot be driven and he will have to arrange to transport it. No reply. Would you remove his bids if it were you?

We had so much trouble the last time that I am paranoid about this.
