Good morning,

I am after some advice in regards to a cashback claim that has been declined by BuyMobilePhones.net.

This is my third claim of which the other two have been successful however after sending my last 4 months of bills in they have declined payment because they say i have breached my contract my failing to pay my bill (which is not the case as i pay by direct debit) or i have been disconnected by Vodafone.

After speaking to Vodafone on numerous occassions they have confirmed that i have always paid and have never been disconnected. I have forwarded emails from Vodafone (not acceptable by BMP.net) and an official letter which they say they have not received.

I am getting to the end of my tether with this, endless phone calls to Vodafone and BuyMobilePhones.net, they have all the proof needed but still put up barriers!

Please could anyone advise me on how i take this matter further and what legal options are available?

I WILL NOT BE USING THIS COMPANY AGAIN!

    A Letter Before Action, then Small Claims Court (online). If they don't pay after the letter, they will after you submit a claim, but before the court.

    1) Check all your bills.

    2) check your bank statements to make sure all the payments have been made on time (checking anything with Vodafone is a complete waste of time and checking with BMP is irrelevant).

    3) Make sure you have copies of these things AND details of the claim you made, together with their written reason for rejection.

    I have never known them to reject a valid claim for this reason - so make certain you are correct. Having a direct debit is not the same as it being paid - for many potential reasons. If everything is correct (and the claim month etc is too) then follow Grumbler's advice.

    Your problem seems to be with BMP, not Voda.
    I don't see how Lee can help you. I think he just replied automatically to the thread where Vodafone was mentioned. If so, you are wasting both your and his time.

    Agree with you, Grumbler, but who knows what behind the scene powers the Voda Reps have?????

    OP, please let us know if they can help you as this is a new step if they can and could be very, very helpful on this forum.

    Since the issue is that BMP believe there is a missed bill payment it may have something to do with Vodafone. If it was missed through their error (for example) it's up to them to sort it out.

    The OP hasn't comfirmed that THEIR bank statements (and Vodafone bills) confirm all payments - they have only stated that there is a direct debit in place, which is neither here nor there.

    Given that BMP is an agent of Vodafone and that the WRT do actually give a damn about their company (unlike nearly everyone else who works for them) they would do everything they can to ensure the agent is playing ball. However, it's ultimately down to the OP to take action against BMP if payment is not forthcoming and (quite honestly) IF all the bill and bank proof is there they should immediately have issued a LBA already.

    Just to make sure, tonight i double checked my Vodafone bills and can confirm all payments have been debited from my bank account....so not too sure where BMP are getting their information to say i haven't paid or been disconnected?

    I have been claiming cashback for over 5 years with various companies and never had a problem until now!

    Then it's of no consequence where they got their information from; you can prove you've paid all your bills and met the t&c of the cashback contract with them. Their only chance of a defence would be to respond to your LBA with any evidence of non-payment as they claimed - but I'd leave that part up to them. A proper LBA giving them 7 days to pay up or you will commence legal procedings to recover the claim, court fees and incidental costs and statutory interest is the way to go - unless Vodafone deliver for you.
