Court action threatened

The land owner can claim for trespass but are very unlikely to do so as it's really bad publicity for them to be seen taking customers to court. If you were using their car park for your HGV lorry it would be another matter but not a private motorist.0

I note you have edited/removed your previous posts, but I'm sure Morrisons won't be too worried about a serial offender that never shops at Morrisons......I doubt the press will be too sympathetic either!
Seriously? Do you work for Parking Eye or something?
Your attitude stinks mate. Your deliberate attempts to undermine me isn't doing anything other than make me angry.
The internet is a wonderful thing when people can hide behind anonymous nicknames and bait people who have genuine concerns. So do everyone here a favour and sling your hook while I try and sort this mess out.0 -

For some context, the entrance to Morrisons is located inside a little strip mall called St Cuthbert's Walk. In that mall there are multiple stores, an Iceland, Peters Bakery, Boots and a few other things. Morrisons offer your parking fee back if you spend over a fiver but the rare occasions I do go in there I pay less than £5 for stuff anyway, so what's the point?
The attitude of Parking Eye is that the car park outside the entrance to St Cuthbert's Walk is solely for Morrisons, which isn't the case. Pre-Parking Eye it was a pay and display car park that was self managed for all the stores. Now with Parking Eye, the quality of the car park itself has decreased, there are masses of potholes and the place is a shambles. Added to that the monumental !!!! on that is those meters where you have to enter your reg number, it's a wasted enterprise on me.
I've ignored every letter that Parking Eye have ever sent me. In fact, yesterday I received the second warning for a parking "offence" back in December and I tore it right up and put it in the bin.
I've actually started a petition to get the government to look into their shady business practices because I feel they're a menace to the average consumer.
Don't pay your fines, complain to Morrisons and just let them waste their paper, it's not good for anything.

Get the Planning Permission or email the Council to get confirmation whether that car park is for any local shoppers, or only Morrisons shoppers.
Quite possibly it's for anyone shopping locally, as is the case with an Aldi car park in Portslade (CLICKY) where they were fined for trying to limit people's parking to an hour and then had to rip down signs wrongly saying that the car park was for Aldi customers only. Both of these went against the original Planning Consent and as this forum has 3 Brighton-area regular posters, sneaky stuff like that was never going to go unnoticed!!
The planning consent may help in your evidence if PE say that it's a 'Morrisons only' car park.
Hope you are getting help on pepipoo with your defence. Clearly Lurka is watching so make sure you only exchange details with a pepipoo regular like gan or Wageslave, bargepole, bama, broadsword.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Cheers mate. I'm not worried about Lurka, mostly because a friend of my wife is a solicitor who specialises in this kind of thing. He's going to help me prepare my defence. Fight fire with fire, as it were0 -

I am a girly not a mate!
Glad to hear you are getting help but also look at the BPA code of practice and identify any breaches in that, as well as contract law stuff which the solicitor will be familiar with. We have seen small claims defended citing BPA CoP breaches - and judges do take these breaches seriously, seeing as it's the only recogniseable form of regulation to compare the PPCs' actions with.PRIVATE 'PCN'? I'm pleading Geordie, so you'll be "mate" or "pet" :P
I'll look into the BPA stuff too. Cheers0 -
Ha ha . . "Lurka" . . . is it just me?
The name gives me a vision of someone who hangs around carparks in a dirty hi-vis jacket :eek:0 -
Hi everyone, i thought it only right that i share the below reply i sent to parking eye appeals as it contains some very important information about the photographic evidence they apparently issue you with.....i hope it helps, i have also sent this to my local trading standards office.
Dear sir,
Upon reciept of your parking charge notice and having returned to the car park in question i will not be making any payment as i have not breached the conditions as stated on the signage in the car park.
Upon entering the car park your signs clearly state that individuals must ensure they purchase a valid ticket. After taking some considerable time to park due to it being mothers day and being extremely busy i made my way to a ticket machine, after entering my registration and paying for the 2hours parking that i required i carried on with my business.
Upon return to my vehicle and being within my 2hour time allocation as stated on my ticket i made my way to exit the car park.
Your parking charge notice shows me on camera entering and leaving the car park however what it lacks is proof that i overstayed my allocated parking ticket time which is the subject in question.
I paid for a parking ticket from a machine that provided me with a 2hour parking allocation as printed on the ticket i received, no where in the car park does it state that my allocated ticket time starts from the moment i enter the car park and times me from that moment until the moment i exit??
Not only does it not state this anywhere in the car park it also proves that your camera system is being used to fraudulently decieve car park users into paying fines that have been issued illegaly.
I will be sending a copy of this email to all retailers within the wharf retail park and also to trading standards to ensure that this practice is erradicated and future users of the parking facility are not subjected to the same illegal issuing of fines.
After receiving this notice and have carried out research into your company it is clear that this is something that your company does frequently. I can ensure you that i am prepared to take this further in the interests of not only myself but in the intersts of other innocent victims of your illegal practices.
Regards,

You should not have called it a "fine". Using that word only gives it a legitimacy it doesn't deserve. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0
