CSA arrears of £38k

Hi all,

Looking for a bit of advice...... or help.....

Ok here goes, i became a NRP in 2000, went back to my mothers where CSA carried out a maintenance calc, which came to £79 a week. I was 22 and buried my head in the sand...... i lost my job and became self employed..... i paid what i could to the PWC.
In 2004 i notified the CSA of the ridiculously large maint calc for 1 child, i know this because it is in my DPA files i have.
Ok so the amount has been accruing and i have been guilty of burying my head in the sand. I refused to deal with the CSA on a matter of principle, i paid what i could for my son, despite erratic periods of self employment.
The fun and games really started when i purchased my house in 2006. The CSA tracked me down and started threatening me ect ect which i was expecting to be honest. I have tried to reason with them on the phone with limited success. Needless to say they have LO and CO on the property totalling £38K the only reason they have not forced sale is because my son (who is now 14) stays with me quite a lot.
So i have been steadily accumulating data to try to prove that i have never been in a position to pay the maint calc imposed in 2000. I have got my DPA files from the CSA, all income details from the HMRC (going back to 2000), bank statements (10yrs), ect ect, and the truth is i have been struggling to make ends meet. The maint calc is totally wrong when you look at the facts of what i have been earning over the last 13 years.

So what i`m asking is, i have all this data what do i do next?
Spoke to woman at CSA, who seems reasonable, and she said send it all up to them in Newcastle, and they would look at the case as a whole.
I`m thinking of making an offer of 5k in full and final settlement based on the data i`ve collected, which shows my liability to be virtually zero.From what i can gather, the so called debt is with the PWC and not the DWP.

I`ve had nothing but grief from the PWC who has assaulted me twice in front of my child, which i reported to the police both times. I`ve had to take out a non-molestation order against her during the last 18 month, a real unpleasant character.

Any pointers or advice as to where to go next would be much appreciated.

    Just to add:

    Over the last 12 years, my son has spent approx 70-80 nights per year in my care. I`ve paid for school uniforms, school trips, footwear, clothes ect ect. I have receipts totalling £2.5k (i saved them all) for cash purchases for my son. I also have bank statements showing approx £3k transferring to the PWC`s bank account. I`m not sure whether any of this will be taking into consideration.

    Just made an offer of £5k in full and final settlement.......

As I understand it arrears kept accruing. As for paying the PWC what you could pay to her directly doesn't interest the CSA.

    So what i`m asking is, i have all this data what do i do next?You need to get this sorted pronto. Data - are you suggesting the CSA is wrong -they probably are- BUT from what you have said in your post the assessment is STILL £79 per week.

    Well what can I say. I'm a PWC but totally unbiased and try to help people regardless of whether they are PWC, NRP or NRPP.

    This is rather a mess.I would try to private message Kelloggs on here or Prelude to direct them to your post.

    Is the assessment still £79 per week?

    Neither will be taken into consideration.

    Sorry to be harsh with you. We need some more information from you...see my earlier post and I'm sure other peeps will try to help you.

    I would advise you not to speak with them on the phone and ask them to send everything in writing. From your earlier post you are safe for the time being ( given your son is 14 ) but , in the words of 'The Terminator' ...they will be back.

    And don't trust them no matter how' nice' they sound on the phone.

    Just had another thought. As the arrears are owed to the PWC and not the Dept of wa*kers & pi*ss-artists...lol... it is possible to negotiate with her. However given what you have said things are pretty ropey with her.BUT...

    Try to negotiate with her. Sit down in a neutral environment, stop the bul*sh*t between you and talk with one another as adults. Direct her to this forum so she can read this thread.

    Best to get this sorted and the CSA out of your lives. And as for you, scousefowler,start being a responsible father to your son....ie financial responsibility- private arrangement that both of you agree to- and you to stick to.Forget the bickering, forget the abuse.

    BTW if you offer her 5K when these arrears are 38K- given the assessment(s) are correct- I would feel insulted too.
  • Hi thanks for your replies..... I`ll try answer your queries....

    1) yes i am on CSA1
    2) no i didnt inform the CSA of my COC. Not until 2009. There is evidence of me telephoning them in 2003 complaining about the high maint calc from the CSA`s DPA files.... They didnt re-assess me.
    3) I have paid some money directly, not much, 3/4 grand.
    4) I managed to get a mortgage because in 2006 they were giving them away.......
    5) PWC is constantly at them, updating them ect. She seems to think i earn a fortune and must be salting it away....
    6) I wasnt notified of any court action, i have had problems with my post due to a new housing estate being built and a new house basically having an identical address = nightmare
    7) I`m collecting data for my own sanity, as well as in the forlorn hope that i may be able to present it to someone to show that i have not been evasive or lying to anyone.....
    8) I made contact with the CSA in 2009 and had a reassessment carried out which dropped it to £35 p/w. I`m now a full-time student at uni, which means i`m exempt from maintenance calcs as per CSA.

    I think the biggest mistake i have made is burying my head in the sand....... i should of informed them of my COC........ but my COC was changing almost every week, not knowing when i was going to be working and for how long ect.

    The people i have been speaking to are the legal team at Newcastle. I think they are case officers yes.

    Basically i`ve been speaking to them today up at Newcastle (the legal team) and the debt is totally with the PWC. Not a penny owed to DWP. So i explained what i was doing and i wanted to send them my case along with a letter of settlement with a full and final offer, he said dont send all that up, because your debt is essentially with the PWC, just make the offer over the phone and i will convey and get back to you.

    I`ve worked it all out and i have made a reasonable offer in full and final settlement, as i see it, not as the CSA see`s it.

    I was wondering, just how can an MP help? Do they take any notice of MP`s???

    Do you see what is going on another post? The case has prelude ( love the musical allusion and the kelloggs..perhaps not but the illusion is clear ( honeyloops) helpers...govt helpers..here having a go at me.

    They only deal out useless...well slow info to say the least...they are aghast at my usual advice to involve MPs, order complete account breakdowns blah

    WOT A SHAME...making more work for the govt :rotfl::A:T:beer:
