Well done for persevering - and quite right too! Shocking that they would say anything else to people and shocking that they think customers will take these threats and demands lying down!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi,
I know this was a few months ago, but the same has happened to me today and I was wondering what action you took in regards to the parking ticket, did you pay it, ignore it or appeal it. If you chose to ignore it did anything happen.
Thanks0 -
It would be helpful to create your own thread, the advice in this one is meant for the OP of the thread, we can't be reading through an entire thread to see what has happened with you. Please start with an explanation in your own thread. Thanks

We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Please start a new thread of your own with a bit more detail of your situation and we will give you best current advice. This thread is more than 5 months old and things have changed (they always are changing) since then.
Ignoring is definitely NOT the way any more to deal with these parking charges. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Desipte shopping in ASDA, I received a PCN from Smart Parking Ltd, which I have contested .... but to date still received no response from them. I have also contacted the store manager at the ASDA branch concerned ... but to date have received no response and also DVLA to ask why they have released my details to a 3rd party without sufficient evidence of any breach of rules/laws etc by me. DVLA send me a response which pretty much states they do not seek proof of transgression and if an electronic request for information is sought, then it is highly unlikely they will seek further evidence ... but they receive £2.50 for every enquiry DVLA receives ... another easy money spinner so both DVLA and the parking pirates win out!! I will not be paying my PCN and have bank statements to prove I was shopping in ASDA during the time the PCN was issued. The DVLA response is posted below, in case anyone is interested:
Thank you for your recent correspondence regarding the release of information from the records held at DVLA.
DVLA takes very seriously its duty under the Data Protection Act to protect the privacy of the motorists whose details it holds on its record.
Regulation 27 of the Road Vehicles (Registration and Licensing) Regulations 2002 requires DVLA to release information from the vehicle register to the police, to local authorities for purposes associated with the investigation of an offence or decriminalised parking contravention, and to anyone who can demonstrate ‘reasonable cause’ to have it.
The need to contact individuals who may have failed to comply with the terms and conditions for parking on private land is considered, in most circumstances, to be a reasonable cause. Unauthorised parking on private land is a problem many landowners experience and providing them with information is necessary to allow them to enforce their rights to their property.
Companies can also apply for electronic access to the DVLA’s vehicle database. Electronic links are used to deal with requests, which are of a high degree of standardisation, such as car parking. Requests for information which are submitted using the electronic link are not required to submit any evidence with their request, however, this evidence must be made available upon request from the DVLA. I can confirm that the request on your vehicle was submitted using an electronic link system therefore the DVLA holds no information on this request. (So lucky me, they just gave it anyway!!)
The Information Commissioner’s Office is aware that DVLA data is released for this purpose.
If you feel that this notice was issued unfairly, you should raise your concerns using the appeal system in place by Smart Parking Ltd. (I have done so, but they have gone very quiet)
With regards to your query relating to the fees charged for this service. A £2.50 administrative fee is applicable for each enquiry received at the Agency.
I hope this explains the Agency’s position in this matter.
Kind regards

If you shop at ASDA,Fulwood twice. You will be sent a paring fine for overstaying!
Reading through the forum looks like this is a longstanding problem.I have had this experience too.
Is there no way to report this company -SMART(sic) PARKING to the anti fraud department?
ASDA should wake up before people are forced to stop visiting their stores in protest.Do they have a customer service department-one wonders?0 -
