Not quite - the grandson isn't counted - only the four kids. They want the 2 older girls to share and the younger girl and my boy. My grandson isn't included in the calculations as he is kinship fostered.

How bizarre what so he isn't there?! Where is he? He's invisible!

I would appeal I'll see what more I can find out over the next few days but as everyone only has a limited time span in which to appeal it needs to be done sooner rather than later. Just a brief letter saying you want to appeal the decision as outlined to poster above.

You should apply for a DHP as well if you are going to be very pushed, the Government took £5 million back with the announcement of the foster children/army (+ to cover the severely disabled children that can't share).

In the meantime you will have to pay.

I'm glad you got suitable accommodation sorted for your family it can be very difficult to get the right accommodation.

You mention your sister-in-law staying is this to help with caring for your daughter to give you or wife a break from caring so you can get a couple of nights good sleep for example?

If this is the case you may have a argument that you need the extra for room for a sleep-in carer to give you and your wife respite. It is highly lightly you may need this in the future anyway.

From the LA's perspective if they can justify the spare room under the regulations for a sleep-in carer rather than pay DHP it makes sense to do so.

    hi
yes sister inlaw stay so we can have a break

It will be even worse when the cap comes into play as it will happen around the same time the SGO should be granted in court for him and he will no longer be a kinship foster child and I can claim the CB and CTC for him - although the cap then means that I lose everything I would get for him, but I wont see a reduction in the housing benefit then as I wont have an extra room!
I think you will find that once you are eligible to claim CB, the child will be counted as part of the household

Ok seana I thought that might be the case, would your GP confirm this do you think that you need a break? Or another professional working with your child?

I think you do have good grounds to argue the extra bedroom for a sleep-in carer. The problem is that some LA's are insisting it must be a carer for the tenant! So I can see a ruling happening on this but there are some cases going forward in May for judicial review.

So you may still have to appeal, you need to contact them and see what they say based on sister-in-law providing respite.

Every Council has been able to introduce their own scheme. It is now a postcode lottery as to what relief you will get on your council tax. I am very surprised that the media have not picked up on this ... I certainly tried to raise it a few times, but perhaps now it is starting to affect people there will be more interest. Councils had to consult on what scheme they would introduce, but as with all council consultations you can bet it will have been very low key.

Very true LittleMax and also some areas like ours are absorbing the 10% cut, for the first year which I think in many ways is wise because they can see what happens over the next 12 months and the pitfalls in it. Probably saves a lot of admin and costs anyway be interesting to see what those are once the system kicks in!
