    I've had similar near misses while reversing out of spaces with a restricted view. Despite seeing a car slowly reversing accross their path some drivers insist on driving through the diminishing gap. I recently had a woman angrily glaring at me and sounding her horn at me when she drove into that car park lane and found me reversing slowly out of a space due to a car parked very close along side me. If there had been any space behind me I expect she would have driven through it and blamed me for the accident.

  • Firstly I hope you did not admit liability. Secondly if he was pulling out of a space it is his fault. Leave it to the insurance company. Have you got witnesses bear in mind no one can tell the difference between 5 and 7 mph so do not worry.

    Even if the car in question was showing an indicated speed, there is no legal requirement for this speed to be accurate.

    The legal requirements for speedometers states that they only need to be accurate between 25mph and 70mph (or less if the vehicles max speed is lower than 70).

    I don't know why people don't reverse INTO car park spaces and driveways, it's much easier and safer to drive out forwards.

    If the damage is to the side of the OP's car and the rear of the emerging one, it should be reasonably obvious to both insurers what happened.

    If it's the side of the emerging one and the front of the would-be passer, that might be trickier to resolve, an argument about what was being assumed about giving way.

    A significant proportion of them will put the shopping in the back of the car.

    And actually reversing into a more open area might be easier than a tight space.

    I ALWAYS find a bay through which I can go to park in the bay ahead. In case you can't figure that one out it means I'm then facing out of a bay and can therefore drive straight out. :j

    Yeah I agree with you entirely but insurance companies work in strange ways. Look at what Norman wrote:

    There are two sides to every story. The guy in the other car may well say something like this and then that puts a new slant on the ops story doesn't it. No-one here has disagreed with Norman or tried to suggest he is at fault either so naturally the insurers may not completely agree with the OP.

    Like I said, I see this becoming a 50/50 settlement.
