Angry tesco man.

Good day fine people.
Yesterday i drove into my local tesco car park to do my friday big shop on a wednesday. As i was finding a space, a lovely looking big black car handily reversed out of a parking space into the side of my car. I figured he should have been looking where he was going, swap insurance details and get on with life.

I got out of my car and was greeted rather nastily by a gentleman who looked like tv psychic superstar sensation Derek Acorah, ( i knew it wasn't him, he would have "felt" me coming and wouldnt have hit me.) He was furious, (making the situation slightly more hilarious) and demanded my details so he could claim from me. I was shocked, (even more than the time i mixed up washing up liquid and tomato sauce).

He said i was at fault because i was going "more than 5mph." He was right, i was doing 7 mph. So just for the sake of opinion, was i at fault?

TL:DR : A bloke hit me and went mad.

    He's hung himself with his comment.

    In order to make an assessment of how fast you were driving he must have seen you.

    So he saw you, decided you were driving too fast and made the decision to reverse anyway!

    Personally I think he's at fault but I see this being a 50/50 settlement.
  • exactly as i was going to say. he saw you moving spedily along and decided to reverse into you to angrilly get out and tell you your at fault, i would go as far as to say to your insurers, that he has said you were speeding so he had seen me reversed anyway and firmly believe this was a crash for cash shunt he tried pulling off.

    I witnessed something similar in Wilkinsons car park near me not long ago - slow-moving car going past the car park spaces, parked car reversed right out into slow-moving car.
    Both cars stop, to get insurance details etc. Woman in reversing car came out cursing, saying slow-moving car must have been racing up the aisle because she didn't see her when she reversed. Erm no, no racing going on, reversing woman was just in a hurry and didn't want to wait for passing cars.
    Reversing woman left pretty sharpish and with a red face (after reluctantly giving the other car driver her insurance details) when I (in car behind slow-moving car) and the guy in the car behind me in the aisle both got out of our cars, having seen the whole thing, and told slow-moving car driver we'd happily leave our names etc with her if she wanted to contact the police etc.

    First, you can't be "speeding" in a public car park because there are no speed limits. Tesco may ask you to drive at 5mph but it's not legally enforceable.

    You could potentially be prosecuted for careless, or even dangerous, driving if you went haring round at an obviously excessive speed but if that was the case then the damage to the cars would show it.

    That aside, he's moving away from stationary so the responsibility to ensure it's clear and safe to do so is entirely on him. Whether he saw you or not doesn't alter that - if he didn't see you, he's at fault for not seeing you. If he did see you but moved anyway he's equally at fault for moving off into a car he'd seen.

    Actually that's not as far fetched as it sounds, I come across vigilante nutcases every single day.

    There is no such thing as a 5 mph speed limit, in fact many cars don't even report their speed once you get blow 10mph.

    The guy reversed out of a parking space into moving traffic on what is effectively a road, so 100% his fault.

    Did you get any witnesses?

    Why? A car reverses in to the side of another vehicle, don't really a complex one now is it!!

    Easy op not at fault settlement

    It could be seen as 50/50 if it's shown that the OP wasn't driving to the conditions, ie, driving at an inappropriate speed in a busy car park.
