    I've just received my bank statements and found the entry for the flights but unfortunately the statement doesn't show the booking reference, however if I go to court it all adds to the body of evidence that I did fly with them. I'm waiting for a SAR request to come back from Thomas Cook. Posted that on 15/03/13 but needless to say I haven't had anything back. I might drop them a line and tell them the exact date I booked the flight and that my SAR will confirm that and see where that takes me.

    Don't know if its of any help to anyone but I just googled my flight number and date of travel and the search came up with the website Airfleet.net. This website had the exact reason why my flight was delayed - because the flight out to us had to return to Gatwick to have a navigation system fault corrected - it said "

    Remark : Returned to LGW approx 1.5 hours into flight to have nav system fault corrected. Departed approx. 9 hours late with same aircraft

    As I say I don't know if this information will help anyone but it will certainly help me when putting my case together. :)

    I am about to sibmit a claim to Continental airlines for a flight delayed in 2008. Obviously I do not have boarding passes or invoices for this flight.
    My first hurdle is that continetal were taken over by United airlines and I am looking for an a address for them. Secondly since the flight went into the states then the visa waiver system will prove we were on this flight as will our progress thro immigration. Has anyone claimed an american airline yet, and if you did how did it go.

    In which case, if they claim EC, thn theEC didn't affect your flight directly, it was the previous flight.
    Any joy with SAR? There is a time limit on how long they can take to reply. 40 calendar days (not working) so they should get back to you before 25th of April by my reckoning?

    That was my thinking. I know the case mentioned talks about denied boarding specifically but the principle is the same.

    I haven't heard about the SAR yet although I emailed them yesterday. I said that I now had my bank statement as proof that I made a booking with them and that when I received my SAR details from them the booking would be confirmed. (I've also emailed the hotel i stayed in for confirmation of my dates that will tie in with the flight).

    I did point out the futility of their insistence that I provide them with a booking reference especially as producing a SAR report is no doubt a lot more labour intensive that pulling up my name and address on their system. I also gave them two weeks to respond to the email and said that if I hadn't had a reply i would initiate court action.

    Had a response to my SAR. TC have said that they have carried out a search of their booking system using my name and address but that hasn't returned any results and that this is likely because my booking was made some years ago and they only keep records for a limited period.

    They have also said that because I have included a flight number they have assumed that my request is a request for information rather than a SAR (although they haven't returned my cheque).

    They have asked me to provide details of my booking so they can check if they are still holding details of my particular booking.

    I'm happy to provide the information but as my letter was specifically a SAR are they not legally obliged to do as requested?
