    Thanks for the links guys

I have emailed in a complaint about the agent and him signing a false declaration, adding info after he left, not showing me the back of the form, etc

Not sure it will do any good tho, but its done now

    Thanks

Why on earth are you telephoning and e-mailing when you have an allegation as serious as this? You have a court summons, you are at risk of a criminal record, you are alleging you were lied to by the inspector and possibly documents were falsified!! Write a LETTER of complaint and send it recorded delivery, keep a copy and a copy of the Post Office receipt.

TBH I think you are stuffed, you don't seem to have committed an offence on the day if you were not using equipment to watch live broadcasts BUT you have admitted guilt by not bothering to read what you signed and you admit to committing an offence on previous occasions. Did you have a TV license up to the date you took over the new property/ moved the TV set or had you already let it lapse?

It wasn't "not bothering to read".. Not bothering to rwad would be -
Agent- would you like to read this before you sign it...
    Me - no... I can't be bothered...

    It was nothing like that!

The reason I phoned is because the telephone number for tv licence was on the court summons!!

On another forum it says don't go to court, just take the fine in your absence, cause if you do go to court the judge could reduce you to tears, question u etc. Tv licence have told me the recommend I do go.

I did intend to go,... And say I wasn't cautioned and the information was not recorded accurately on the form, now I don't know what to do!

Any one know what the usual fine is, and can I go alone or do I need a solicitor, will they have one. They have told me the inspector will not be there on the day,

Definitely go, for one thing it would be very rare for there to be a judge involved in a normal TVL case (they're usually dealt with by magistrates), make sure you've got some notes about what was said/why you signed etc, and remember you only need a TVL if you watch or record live TV (not just on a TV but on the PC etc), if you didn't watch Live TV or even better didn't have a TV at the time you didn't need a licence.

On this day I did not have a tv, most of my stuff was already gone to my new house

But honestly, I did have a tv previous and no licence

But what is the definition of "live tv", I would only use the term live tv for football (eg its on live) or the news etc. Is live tv all tv as its shown, eg corrie etc. Does it cover plus 1 tv channels?

In this case, "live" TV refers to "as it is broadcast", so if you watched Corrie on ITV1 when it's shown, then that's considered "live", even though stuff like Corrie is recorded prior to broadcast.

What if you watched it on itv2 or on plus one as a repeat?

Then how do u prove that u don't actually watch live tv?

I thought u needed a licence if you had a tv, if its for watching live tv, I didn't need one anyways, confused.com!

IMO, ITV2 and ITV1 +1 still count as a live broadcast as they are still being shown on the TV network.

ITV2 and plus one count as live TV...but...ITV player does not. The easiest thing to do to avoid needing a licence and being tempted to switch to a live channel is to disconnect the TV from the aerial or satellite dish, plug it into a games console or computer and watch TV programmes (not the channels though) via the internet.

It's not up to you to prove anything...it's up to the TV licensing inspector. You can answer the door to the TV licensing person if you wish. Tell them you don't watch live TV and shut the door with no further comment. Getting your phone out to record the conversation on video will also make them scamper. They have been advised they should not be recorded and should leave....unless they really want to see themselves on Youtube they'll go. If you do not let them in they don't have proof.
