Have a read of Martin's article and you'll find a link to CAG for the Court Bundle which you will need to prepare once you get a court hearing date.
You may well hear from the bank's solicitor asking for further information next and will get a letter telling you which court you will be transferred to and if you have to fill in an Allocation Questionnaire or not.

I have received a letter stating that the nationwide intends to defend all of the claim. I am also under Northampton court. Apparently they now have 28 days to file a defence. I am really hoping that it doesnt go to court and that they just put my money into the account!! It appears that the banks are playing hardball at the moment.
!!!!! This is my first ever thread so i do hope that i have placed it into the correct place!!

All cases put through MCOL start in Northampton as it is the local court to them. Once or indeed if it goes any further your case will be transfered to your local court.0

Please can you help me, my situation is similar to piggy69 although I was unable to find the response to this thread, I will try to keep it brief.
I went through the process of claiming the bank charges however, I have recently received a copy of Abbeys' defence. They are stating that my account is subject to their terms and conditions which I agreed to when I opened the account, basically they made me aware of the consequences of being over drawn. Also that the fees are proportionate to the expenses incurred due to my breach of contract and is a genuine pre-estimate of the damage which Abbey has suffered. Furthermore they stated that I should provide strict proof of admissions.
I'm not sure what the next step is, will I have to prove my case in court if so what would I need to provide? Are Abbey likely to attend court and defend the case or are they testing my endurance.
Please if any one has gone through similar situation, please can you advise me on what steps are needed.

Basically you need to read, read and read, this thread and others that are linked in the Reclaim Help Thread and have a look at the relevant thread for your bank and see how other users are handling their claim.0 -
Any ideas on what I should do: I was reclaiming my £45 in charges from Smile (the second time I've done this). They sent me a letter which told me to wait for eight weeks. I sent them a letter saying that I was not prepared to do so. As it was, I couldn't afford the £30 moneyclaim fee so waited for the length of time they stipulated. They didn't even bother to contact me. I rang them when the eight weeks were up and asked them why they hadn't given me a "definitive answer" as promised. The only thing I was told was that I would have to wait another two weeks. No explanation or anything. So I took it to court. The claim was lodged and over the last seven days they have returned my money to me (without saying anything to me about it). Today I received two letters: one the usual, "we have decided to refund the charges as a gesture of goodwill" and th other a copy of the acknowledgement of service, informing me that their solicitor is defending the charge.
Obviously, I have the money back now, but I haven't received the £30 court fees from them. If I leave it now, in effect I've only recovered 33% of the money they took from me.

Abbey have informed the small claim court that they will fight my claim.
I know I have to prepare for a cout hearing, but not sure what this means, how to go about this or what info I will be required to submit. Has anyone been to court yet, and what happened?
I've been trying to find out about recent court judgements to see how things are going- are people still winning?0 -
Bank has put in a defence and I noticed in thread that I should have sent copies of claim toNorthampton Court. I didn't know and have not done so. Will this cause a problem.?0

Quick question, I have put in a claim again TSB for bank charges. I have gone through MCOL and TSB have followed their usual procedure and are defending the whole claim (no suprise there). As it will go to my local court now how long before I recieve the paper work ie questionaire etc?
