Firstly, don't panic! The bank does have every right to defend your claim against them. However, the legal jargon their solicitors use is designed to intimidate you into giving up.
The next step is to start getting your court bundle up together. This is basically three copies of everything you already have: your list of charges, your letters to the bank and any letters from the bank. Depending on the actual defence, you might need some other more legal documents, but we can tell you what you need and where to find them. One set of copies will be waste paper, because the bank’s solicitors won’t turn up. They daren’t. The last thing they want is to have to answer some potentially very expensive questions, such as just how little it does cost them to administer a late payment, overdraft, etc.

The court will now write to you, giving a date for the hearing and enclosing a copy of the bank's defence. They might also enclose a form called an Allocation Questionnaire, but a lot of courts aren't using these any more, as they now know what these cases usually involve, how long they usually take and that the bank’s solicitors usually don't turn up.

I have request around £600 from Abbey in bank charges. I paid £50 to take them to court via moneyclaim.
The stage I am at now is Abbey have sent me a copy of their defence dated 29.05. However, I have not submitted any sort of evidence. I have waited for Northampton Court to contact me but this has not happened.
Should I send copies of my bank statements to court? What covering letter? Is there a template?
I'd appreciate any help.0 -
You will receive a notice from Northampton court but bear in mind they are very busy lol. You should be able to track your MCOL on line.0
