    your being thick lol....this is basically all your letters to and from your bank ..your schedule of charges and statements to back them up. go look at the reclaim your bank charges help thread....its immensely helpful

    i also applied online to take my bank to court, cost £120. after several weeks they switched it from northampton so i had to pay a further £100 to be heard in my home town. i have added this to my total claim

    Hi all

    I have had my transfer of proceedings notice this morning. No date however. I assume that this will arrive in the future?

    Also the bit about the allocation questionaire has been crossed out because Judge Murdoch at Northampton has dispensed with it??????
    Unless that is The district Judge orders otherwise.
  • Hi everyone, well similar story to alot of threads on here but just want some reassurance.
    Have followed advice with template letters to claim back £1190 (with interest) but got no reply so went through moneyclaim (further £120). They acknowledged 1 day before the cut off date and I have had letter back from courts to say they are defending the claim and have 28 days in total to reply, this would take it to 16th June.
    I have had a standard letter back from the bank basically stating that they will not budge and their solicitors are dealing with it.
    All I am worried about is if they leave it really close to the cut off date and request more information, ie: breakdown of the charges, and it goes past that date - will this be thrown out of court?
    Any advice welcome - Please!

    All fairly normal. In our case LLoyds acknowledged and their solicitors sent a letter requesting breakdown of charges, claimed we hadn't done it before (no, only two times before, LOL). Then they defended at the last minute. Sent a pretty laughable 3 pages defence ("these fees are not penalties, they are fees for a service"), and tacked to the defence was another little letter offering us the whole amount including interest and court fees in full and final settlement. The cheque went in the bank on Monday.

    Need some advice, Lloyds TSB are defending my claim against them for just a little over 3K, anyone know how i should thouroughly prepare just in case i ned to attend court?

    Yes, we do. And thorough preparation is vital: the recent cases that have been "lost" have been due to poor preparation, not any merit with the banks' case. Even though the bank's solicitors won't attend the hearing, you still have to prove to the judge that you are due your money back.

    The next step is to start getting your court bundle up together. This is basically three copies of everything you already have: your list of charges, your letters to the bank and any letters from the bank. Depending on the actual defence, you will need some other more legal documents.

    Hey Guys hope you can help,

    Lloyds are defending my claim. After their win in court I kind of expected this. Currently I am awaiting the court date. Getting a little worried now.

    Does anyone have any experience with this.

    What evidence do I need?

    How do I argue this and does anyone have a copy of a sucessful argument?

    What do I need to prepare?
