    :confused: I have been trying to claim £2360 from Lloyds bank since February 07 on behalf of my boyfriend. Last week Lloyds defended our claim at the last minute. I have still not received an Allocation Questionnaire - How long does this usually take? I have prepared 3 packs for the court with all letters to and from the bank also with a copy of the Unfair Terms in Consumer Contracts Regulations (1999). I will be sending a copy to the Court and the bank with the allocation questionnaire (once it arrives) Is this the right thing to do and is there anything else I need to send with it?

    A lot of courts aren't using the Allocation Questionnaire any more, as they now know what these cases usually involve, how long the hearings usually take and that the bank’s solicitors usually don't turn up.

  • I've received a letter saying that the bank (Lloyds TSB) are intending to defend all of my claim against them in reclaiming my charges. Has anyone got any information to help me?

    Lloyds solicitors sent me the same letters to say they were defending my claim about 6 weeks ago, I recieved a date for court...13th August, and then on Thursday I got a letter to say they were paying me in full....in fact they paid me £100 over, for the allocation questionnaire, which I never had to fill out, so I am now £3316.98 better off thanks to them...

    So dont worry too much and stick with it....its worth it...

    Lloyds have just defended my claim - well on 11th - im waiting for a 'stay' or a hearing date now. How long after they submitted a defence against you did they pay you ? Im just impatient :rotfl:

    i received a letter from solictor saying they are defending the claim, so know it gets worrying ,can any one tell me whether they have had the same happen to them. my local court is bournmouth, will i have to attend? is anyone else in this position.:cool:

    Yes I have had notification from the court that Lloyds TSB intend to defend my claim of £ 2800.00.

    They have until 18 July to submit their defence. Like you I'd like to know what we do next!!

  • Hope someone can help, I am a little confused by the dates. I Received a 'Notice of Issue' after filling in the MCOS form online. This stated that my claim was issued on the 5th June, it was sent to the defendant (Nationwide) on the 5th June and will be deemed to be served on the 10th, the defendant has until the 24th to reply. I have since received a 'Notice that Acknowledgment of Service has been filed' saying they intend to defend the claim, the attached acknowledgment was dated the 7th June and the covering letter says they have 28 days from the 'date of service of the claim form' to file a defence. WHICH DATE IS THAT????? Am I now to ignore the 24th June? When do I count 28 days from? And should I be doing anything else? Or just sitting waiting? Hope someone can help.

    Just thought I'd pass this on, in case anyone thinks its worth following up.
    My Natwest claim has now been referred to my local court, as they have put in a defence. I contacted my house insurers as I saw that I am covered for 'legal expenses'. I explained I may have to go to court to justify to a judge why I think Natwests charges are unfair, and to ask whether I might be able to apply for some legal support eg a solicitor, if I have to go to Court. As well as being very helpful generally over my case (I was put through to their legal department) she said they would give serious consideration to my request. They are sending me forms to complete to give the outline of my case and will let me know shortly.
