    I'd consider it miss-selling if a shop sold you a contract costing £X, knowing that it was going to go up to £X+2.8% (and they withheld that information)

    that was the only concern that they hadn't been fair at the time of sale

    In which case she would have known all about the price rise due to the letters and emails that were sent out to all O2 customers.
