Am I right? Hubby purchased a pair of trainers for me today in a sports store, once home they did not fit me length or width wise, I returned them to the store within the hour to get a refund.
I was informed it was company policy to only provide an exchange or gift card- I would have been happy to accept a gift card if the sales assistant was not so rude so feel I would prefer to spend my money elsewhere. Am I entitled to a refund?
In what way was the sales assistant rude?
Was it just because you wanted a refund and (as you now know) she was not obliged by law to give you a refund?
How did you leave it?
Do you still have the shoes that don't fit?
If it were me, I'd get back pdq and accept the gift card or exchange.
It's shops such as M&S and Next who offer refunds if you just change your mind (which in reality is the situation you are in) that give people the impression that all shops should offer the same but they actually offer over and above what the law says they have to.0 -
Always best to ask when making a purchase if not sure.
As said M&S are great with this but other stores do each have their own policys.0 -
Just been relieved of £10.99 by a Sports Direct store. Bought mens shorts size XL (37-39ins) on the label, which for me usually ensures a perfect fit. Should have tried them on but was in a hurry. Didn't fit!! Too small. Went back - they don't do a larger size. No refund. The assistant pointed-out a small (6ins x 3ins) sign stuck on the counter (just where I would have PLACED the shorts when I bought them) and then told me it was on the back of the receipt as well - which of course I would not have seen until after I'd paid so how pointless is that! I'll give the voucher to somebody to use and NEVER go into this store again.0

Unless of course the shorts are mis-labelled, and are not in fact 37-39".

Measure your waist.
Measure the shorts.
IF waist>39", hang head in shame.
IF waist<39", go back and complain.Should've = Should HAVE (not 'of')

Normally, this sort of measurement isn't much good for items such as the shorts.
When something is marked with a definitive size such as "waist 37", then that is the size you would expect them to be.
However, if they are shown as fitting a waist of 37" to 39" then they are probably elasticated and would therefore probably be around 35" to 36" in their unstretched state.
If they were 39" then there is no way that they would stay om someone with a 37" waist.0 -
You lot are so funny how you protect these shops. Yes they are operating within the law, but they are giving very poor customer service.
The only way that High Street shops can compete with internet stores is through looking after their customers, if they don't see this they are doomed.0 -

And you are so funny in that you don't seem to understand that this is a consumer rights board and the replies given have been to advise people of their rights.
If a shop is operating within the law but doesn't give what you feel is good customer service, surely a good place for comments would be the "Praise, vent & warnings" board.0
