Even if ASDA didn't own the car park, it certainly is not owned by Smart Parking. So they would have no right to make any penalty charges.I can afford anything that I want.

Thank you for those replies, spoke to daughter and read them out to her, hubby says they should just pay up, as she did wrong, she knew she needed a ticket and broke the law.
so daughter is now upset at home, as i told her about this site and not to pay.

And state exactly which law was broken...... Someone is far to Gullable.....For everthing else there's mastercard.

I know, and as soon as daughter told me about the ticket, i told her not to pay.
But not everyone goes on here, and come on guys you lot know the ropes, thankfully i did because i read a lot on this site.
but they are kids and all they see is a yellow parking ticket sticker on the window, and i fine inside.
And they are decent people, who knew they had done wrong, and i guess that is how these companies make there money from people like my s-i-l
They will not be paying, and i will be taking the receipt and ticket into asda tomorrow, and asking the manager to sort it out

Two reasons why St Chris might be advised to go into ASDA re her ticket.
The first is that if she sees the manager, and they cancel the ticket, her mind will be at rest. Not everyone relishes the fight, if you see what I mean
The second is that if she can get a ticket from Sainsbury, Tesco or Morrison that is for their free car park free, she can ask for ASDA "Refund the difference plus 10%" and make some money !!!! :rotfl::rotfl:

Her hubby or yours? Either way, I make no apology for saying quite truthfully, that's a stupid answer from somemone so completely uninformed about this scam that they should not be giving such rubbish advice without checking anything about this con. Does he also fall for phishing email scams? 'Broke the law' indeed!!!! What law would that be then, the one Smart Parking (Australian firm who are just in it for the money) made up?!
This is indeed a scam and is NOT a fine. Hubby may think it is because it impersonates a parking ticket. Your daughter will just get the usual letters just as other posters do, just as I did more than once.
Her choices (if she's the registered keeper) are to ignore it or (if this was in England or Wales only) to appeal, then insist on a POPLA appeal, where you can then ignore it if you don't win the appeal. Explained here by pepipoo forum:

Her other choice is to COMPLAIN in writing (or in person, but NOT by phone) to Asda about this harassment of their paying customers.
I would make it known that she is spitting mad about all the harassment and family upset this has already caused - and she hasn't even had any of the scary letters yet! Maybe wait a few weeks, for some debt collector letters to arrive (as long as she is the registered keeper) and to keep them away from 'hubby' who sounds like he'd believe them hook, line and sinker. Sorry but that's how it sounds. Can I send a demand for money to him please?
Anyway, to your daughter, just photocopy the first few letters and march into the store on a busy day. Slap the copy threatograms down on the CS desk, insist on seeing the Store Manager and demand to know how they think this sort of hassle adds to their customer satisfaction and chances of keeping your business?

Tell Asda how this association is damaging Asda's reputation, to be in bed with a firm which has NO agenda of parking management whatsoever, purely a penalty mentality which is actually unlawful and victimises their most vulnerable/daft customers who will not know that these are fake parking fines and should never be paid.
But basically, like all the other posters on this board, your daughter has a fake PCN, a misleading invoice.
The whole scam of fake PCNs relies firstly on people's ignorance of the fact that a random private company can't fine anyone, and secondly on their natural fear of parking tickets and the escalating costs/bailiff scenario. So PPCs copy the look of a real parking ticket and - hey presto! - the cash rolls in from victims who know no better.
This is not a penalty at all. It's rubbish, there are no bailiffs letters, just debt collector standard template threatograms (all hot air, we can tell you this for certain).

The letters are actually quite funny when they arrive at the address of someone who knows it's all hogwash and not a real parking ticket at all.
My 18 year old niece has EIGHT fake PCNs so far - and laughs & texts me every time she gets one. She is just a new driver, a teenager, and she knows this is all a con like a series of phishing emails. Boy does she get a lot of junk mail!
I would happily collect more fake PCNs than the 2 that I already have for overstays (more than an hour overstays, both times when shopping at Supermarkets at busy times). Plus I have a nice collection of amusing/alarmist debt collector letters which I carry in my handbag to show friends & colleagues if the subject crops up!

They were BANNED for comitting offences against the Companies Act 2006. and these are CRIMINAL offences.
Yes, the DVLA managed to dress it up as a CoP non compliance but it didn't change the underlying reason.0 -
