    They should respond.
How will that fix it? They still won't get the OPs money back! They can't! But if a message from ebay saying just that is what the OP needs to feel better then so be it!

As eBay have assured me that no-one can register on eBay with a fake address and that there are measures in place to stop this.
Think you've been talking to the wrong people!! Foreign accent by any chance, or ebay live chat?

    Hi,

I was recently a victim of an eBay scam where i purchased a mobile phone through eBay and paid via bank transfer but did not receive the goods.

The sellers account was closed a few hours after the transaction which left me with no way to contact the seller through ebay.

I put a dispute in with eBay but they wouldn't help as i didn't pay via PayPal so the matter was closed.

To cut a long story short, i have the sellers mobile phone number, bank details and address.I have screen prints of the eBay listing and a log of SMS messages between myself and the seller before i bought the item

I had an online chat with a customer representative from eBay who advised me to contact their legal department in Luxembourg as i wanted to confirm that the sellers address was legitimate to pursue a small claims court action as the evidence i have makes a very strong case.

This incident happened in November 2012, I wrote a letter detailing what had happended, giving full details of the matter and requesting confirmation of the sellers address.

As of yet i have received no contact from ebay and have sent a further letter together with a copy of the original letter telling of my discust in the handeling of the matter.

It seems eBay are only concerned with taking your money and are unable or unwilling to help if you didn't use PayPal (which is an affiliate of theirs).

I know and admit i was foolish for paying by bank transfer but eBay didn't make things by closing the sellers account and washing their hands of the whole thing

you lined yourself up for this
from eBays side. they have no proof you paid for the listed item at all
SMS messages are proof of nothing
they already know the listing existed as they will see the purchase on your account
go via small claims with what you have,Ebay cant/wont do much more

I would suspect they are unable to confirm or deny the address without intervention from the police.

    Data Protection laws are stringent.

Have you reported it to the police? Although you paid willingly, if the account was indeed hacked you may gain some help via them.

Yes, reported it to the online fraud police - Actionfraud and got a crime reference number.

A friend of mine went through the small claims court recently and could go no further as she had no UK address for the fraudster. The same here, i need to know an address to proceed

The transaction was all done through eBay. The seller sent me his name, bank details and address through eBay. The proof i made the payment is on my bank statement to those account details.

Absolute waste of time. They are overseas centres where English isn't their first language and they will give you incorrect information or sometimes just what you want to hear. A seller can put any address down, as long as it is a legitimate format. There are no initial checks on proof of address and they don't check the electoral role.

the transaction wasnt done through eBay
otherwise you would have paid by Paypal
    why didnt you?
theres no point picking holes in my logic. its you that allowed youself to be scammed.
    my original advice stands
  • No ... "LOST OUT". I lost money. Fact.

(And obviously ebay "made money" from the interest that I lost because they were sat on my money for 3 weeks - so they were clearly in a huge rush to sort things out. Not)

It must've been a very expensive item for you to have been miffed about losing out on 3 week's of interest - my current account only pays me pence and that's for thousands of pounds over the period of a year!

Custardy is correct. All you did through ebay was tell the seller you wanted to buy the phone. The actual transaction itself was conducted outside of ebay and outside of their help and protection. It would have cost you no more to use Paypal and you would have had your money back by now.
