Parking Eye vs Somerfield

Take a deep breath ... it wasn't £1m, it was £350,000.... Still don't understand Somerfield though. I can't work either of the links above. if you are not allowed to send fines out how can you win £1m if someone stops you doing something you are not allowed to do in the first place.
Somerfield terminated their contract early with Parking Eye, and the Judge awarded the sum as compensation for the income PE would have earned to the end of the contract.
This was a commercial contract dispute between two large companies, and has no bearing on the legality or otherwise of the tickets PE issue to motorists.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
So Smith lost and only had to pay for the charges he should have paid on the day and he didn't have to pay any costs. wouldn't like to own a car park seems like you don't need to pay. this is what happened to me in Manchester as well. did he claim that Parking eye can't send out fines cos they don't own the car park. does anyone know what car park mine was on Bloom street.

Re the bit in bold - NO he did not because that only became really apparent as an argument later in 2012 (with VCS -v- HMRC 2012).
Who cares about the irrelevant breach of contract that PE happened to succeed in against Somerfield? I did already explain in my post above, why they won...in just two lines - was it so hard to understand? And bargepole just explained it in one line! This is NOTHING to do with a fake PCN you may have got.
Why do you assume PPCs are 'not allowed' to issue their invoices? We have never said they can't, we just say they are a load of tosh and unenforceable.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just reading everything above does this mean you no longer have to pay for car parking as long as the car park isn't owned by a Council.0

No it doesn't mean that, and we don't condone not paying legitimate charges to park whether its private or council run car parks! If there is a charge pay it or don't park. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

May I ask if you are connected to a PPC?Got a ticket from ParkingEye? Seek advice by clicking here: Private Parking forum on MoneySavingExpert.:j0 -
Why would you though? How can a car park owner get people to pay if issuing a Ticket is a scam and can't be enforced.0
-
No just looking for a legal way to save money0

Not once will any one say do not pay for a ticket to park your car, such a pay and display car park.
What these threads are about are tickets, Penalty Charge Notices from an authority such as a council, the police or 'Parking Charge Notices' from private parking companies. The latter are to be ignored. They have no enforceableness(is that a word?). Thats the way to 'save' money....don't pay the PPC a jot.Got a ticket from ParkingEye?
