Smart parking/town and city parking ticket

Hi all, I received a ticket in Glasgow from this mob of cowboys for parking in a disabled bay. I was borrowing my mothers car as I live in London. I was taking my 93 yr old disabled grandmother out,& put the badge up. When returning I got a ticket for the badge expiring 3 weeks previous of which as it wasn't my car I wasn't aware of. My gran I now know has a valid disabled badge but is with a government body to prove her identity & we are waiting for it to be returned. I would just ignore this but my mothers going mad and she will be the one to get the threats so I have appealed to them explaining the circumstances in the hope they will send any correspondence to my home and not my mothers. Any help would be appreciated. Thanks.

    Now you've told them that you were driving they will send the letters to you ( assuming you gave them your address ). From this point forward just ignore them.

    Whos car park was this?
    Was this an ASDA?

    im going to assume its ASDA based on the PPC ( private parking company) in that case then....

    If possible pop in to the ASDA and complain, if the PPC rejects the 'appeal' you can then tell them that they that is that ASDA branch is in breach of the equalities act as they do not have any disabled parking spaces, the spaces all say badge holders only, and not all disabled people who need extra provision may possess a blue badge.
    and that the blue badge scheme does not apply on private land ( check your handbook)
    You should than demand that they rectify this situation imediatly, and refund anyone who has paid their contractors, for whos actions they (ASDA) are responsable and liable for.

  • Ignore this mob. They are rank amateurs who have recently served a ban from getting information from DVLA and had a slating in the Dundee evening paper.

    I am in correspondence with DVLA about them.

  • Hi everyone thanks so much for your help. It was silverburn shopping centre in Glasgow. Couldn't believe it considering it was only 3 wks out of date... Even if I did know and I parked there my gran is still in a wheelchair it's a disgrace. Thanks again I will ignore!

    It doesn't matter how out of date it was. The blue badge scheme does not apply on private land.

    AIUI that's only where the owner of the car park invites the council in to enforce disabled spaces. No PPC will want that, as they'll lose the revenue from fleecing vulnerable people like your mother.

    Certain PPCs focus heavily on disabled spaces. Nothing to do with protecting the disabled and ensuring there are spaces for them. It's all to do with the fact that the disabled have a higher proportion of people who are easily intimidated into paying than the general population (i.e. vulnerable), and there's lots of scope for "getting" people who have slightly obscured badges, forgot to display, etc., etc.

    No laws have changed in Scotland at all, and the law that has changed in England and Wales don't make these scam tickets any more enforceable that what they were previously. Ignore the parking company completely.

    Complain to ASDA that they are in breach of the Equality Act 2010 through their agents, and if its not cancelled immediately you are minded to sue them and the parking company for a minimum of £500 plus costs for the breach.

    Don't take no or it's not our land etc for an answer, they are in breach sue them if they don't comply, also get your local press involved, a lady in a wheelchair getting a ticket in a disabled bay will be front page news. They should be named and shamed if they don't cancel this.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    No - If the Scottish DPPPA applies and it has to be invoked on a site by site basis via application to the council (hardly any retail operators have done this - last count, maybe three!) the ticket will be a legit council ticket, not one from a shady PPC - And you will have the same right to challenge/appeal informally and take it further to adjudication if you need.

    As its not, just ignore the jokers and all further letters, also read-up on the guidance notes for her BB - they will be on the issuing authority website. You will see it clearly stated that BBs do not apply in private car parks. :)
