You will probaly find that you need to go onto the website, book an appointment at an apple store and then take it in for a genius to have a look at it.

Just checked with the oracle and Oh says it could be battery or the remote on the ear piece or it might just need a re set or the whole button across the top - a reset is possible so oh says plug it into your computer and do a restore on it to start with. If you go on the apple site on the shuffle section it should tell you about any common problems.
