It's a total bluff pure and simple. If this was poker you would be holding a full house where they were holding high card jack. The only way for them to win is bluff you into submission.

If they could do anything they would have done it already. How is it mis sold when it was sold as seen. They saw it, they brought it, they have no case....end of.

Saying they are giving you chance before bad things happen is just pure bluff.

Do not respond. They will soon get bored of sending text messages that get no reply. The moment you reply they will think you actually take them seriously.

If anyone shows up at your door film them on your phone and politely ask them to leave.

Even though I am aware of the fact as a private seller it won't apply but just received this text message from the father.

"The new owner is rejecting the car you miss sold and will be looking to obtain a full refund plus costs under the miss selling of goods act. I will be in touch with my friend and I very much look forward to making your acquaintance."

How do I respond if at all?

    Simple one word text: "LOL".

If the events are as per your OP, nothing to worry about. Buyer can try and quote as much crap as he wants but he isn't going to get anywhere. Caveat emptor.

Ask them which country that act was passed in as the is no such act as the miss selling of goods act.

    Do not be bullied

As I wish I had the money to pay for a solicitor I just cannot afford one and that was why I was selling this car in the first place because I needed a smaller cheaper car to run both on insurance and fuel consumption, as 1.6 cars tend to drink their weight in fuel.

You do not use solicitors in small claims,

It would be easily defended and seen off

  • I have still been ignoring their calls and messages ever since the first time he called and the message he sent today left me a little confused.

"I am waiting outside 'your address' and would like tower up and discuss how you are going to return 'the new driver's' money. Would you please return my text and we can sort this out."

As my gf was home she mentioned that he knocked twice then went away and then came back a few minutes later (possibly after sending the text) and started hammering on the door. Next time he does that police will be getting a call as my gf was feeling threatened and was glad the doors were locked.

    This is now harassment IMO.

Inform the police and let them (and buyer) know that if he shows up your door again the police will be called.

If he is unhappy with the car he can go through the small claims court. There will be no refund without a successful small claims ruling. No further communications will be entered into. Any further messages or visits to your home will be treated as harassment and reported to the police.

Make sure you save all messages and keep a diary of all further incidents. Report all of them to the police promptly.

This is the way to go, advise that you will now be making a criminal allegation.

Otherwise you will see them in court.

They are now harassing your girlfriend as well.
She should make a new complaint to the police.

What did the Police say when you told them he'd been hammering on your door, scaring your gf, OP?
