Smart Parking ticket from TCP

Hi, My husband and I went to Asda today and parked in a disabled bay as we were only going to be a few minutes. Yes, I hold my hand up neither of us are disabled and granted we should not have parked in a disabled bay. Anyway when we returned to the car we found a parking charge notice on the windscreen issued by Town & City Parking Ltd. I have been reading the threads posted re this company and would like some advice as to what to do.

    We don't condone parking in disabled bays when you are not disabled, please think of people who really need these to have access to shops etc. but we are not here to judge you, so just ignore these idiots! They have no right to issue penalties what this is.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Allow me to be a little cheeky to begin. You say that neither you nor your husband are disabled and you got a ticket for parking in a disabled bay.

    Forgetting other advice you will get, I think you were entitled. Reason? Eyesight - as you say you have been reading threads on this forum and every one says the same thing "DO NOT PAY" as these charges are simply speculative invoices. How could you not see the advice there? Follow any thread and see the variations on "NO".

    So, why should the advice to you be different? It isn't, so read up on what happens next with the demand chains and sit tight!

    you can ignore them, but [rant] Disabled bays are there for a reason, by delibreatly ocupying them, when you have no need or requirement to do so is not only inconsiderate, but it also gives the PPcs an excuse to exist and in turn harrass genuine disabled ( and non disabled) drivers[/rant]

  • Thank you to all that replied to my query, I just wanted to make absolutely certain that it was safe to ignore the notice. We don't normally park in disabled bays and this was the 1st and only time and won't be doing it again.

    one more piece of advice, keep all correspondance, do not bin it/shred it whatever, and if your in any doubt about the tickets/letters post them on here, in case you are one of the rare few who get genuine court papers at some poin ( exremly unlikly )

    OK, chastisements over with, you have a couple of choices.
    1. Ignore.
    2. Play with them.

    They are currently being watched very carefully and at the moment are on very dodgy ground regarding their signs.
    Look closely and you will see the name on the signs is not the same add that on the ticket.
    Minor detail but enough to make them back off.
    Wrote to them and tell them to naff off.

    I know.
    Companies House are seemingly happy for these scammers to continue using 'Ltd' on their paper tickets, at least for the time being. Spineless or what?
    But as we know, the signs make reference to some non existent entity. Therefore it would be difficult for them to link the two together., especially as they like to state the info on the sign is key.

    With luck I should have collected another myself yesterday.

    Despite everything here these invoices should never be legally enforceable. Because in cases similar to this people would be liable, for example in another thread I have just posted about a 94 year old without a blue badge who used a bay in an asda, her nephew (the driver) is facing a barrage of mail because of this.

    So if this was binding on private land, how would he be able to prove that his infirm aunt who is covered by the Equality Act is with him? Maybe taking time stamped photos and independent witnesses to prove the point?

    As I mentioned I'm not condoning the actions of this person, but on private land it's got to be down to the occupants of the vehicle on whether they need this space, parking company employee is not qualified to determine whether someone fits the Equality Act definition or not.
