Landlady not returing deposit

Dirt to carpets and scrapes to paint work is NOT wear and tear, it is DAMAGE.
Wear and tear would be for example, carpet flattening over time due to traffic wear or fading where sunlight has bleached it.0 -
In that case I'll offer her £25 that covers a 24 hour hire of a carpet cleaner from B&Q and a pot of paint.
her other half is a skilled decorator so these are will within his ability's.
I'm not paying for professionals to do it0 -
Its not flithy as stated, its a 15 month old beige carpet that I bet one of those carpet cleaners would have like new in 30 minutes, no wear, just a little darker in places
Then why didn't you use 30 minutes of your time - for free - getting it clean?
You still don't get it ... your dirt, you clean before you leave, or you pay someone else!
You are here admitting atleast twice that you know that carpet is dirty ... your dirt ... your 13 months of dirt ... you had a chance to clean ... in only 30 minutes ... yet now you are bleating about paying someone to do your dirty work.
I previously replied with advice on how to claim back the rest of your deposit, less a reasonable amount for the cleaning. Did you take that advice, or are you just trying to get someone on your side?
However you re-phrase the issue here, its pretty black and white - or perhaps "beige with darker bits" if you prefer - carpet, dirty, you clean or you pay!0 -
ok - so did you ammend the contract to state that there were darker patches on the carpet when you moved in? I'm guessing that if it was 2 months old when you moved in that they weren't there at the time of signing and they have therefore occured as a result of your tenancy. And if that is the case then you were responsible for cleaning the carpet upon the end of your tenancy to remove those darker patches. The landlord is therefore entirely within their rights to use a proportion of your deposit to return the carpet and walls to their original state.
If the carpet was like that when you moved in then you should have written the fact on to the contract and had her sign it off.
And maybe it's just me but I've always seen it as a matter of pride to leave a property absolutely spotless...0 -

As you have been advised, you have no right to insist that the owner or her other half carry out the work
The owner does have the right to employ a professional to carry out the work.
If you do not agree to the deductions the owner proposes, you have the right to take the owner to small claims court and let an impartial judge rule on the matter.0 -
She came to me on the Friday 25th, told me they where moving out at the end of March I unless I wanted to rent the whole place I had to move too (no written notice btw)
so I moved as fast as possible to move as I'd had enough
found a place the following day, paid deposit, went I told her the good news I could be out of there on Thursday 31st
that was also my last paid to date rent day.
next few days was spent organising and packing.
The day came, It was 4pm by the time I was done moving.
came back and bashed the room.
cleaned down the paint work, hoovered twice.
looked at the paint, rated barely 1/100 for marks
looked at the carpet, not filthy like she now claims, its a shade darker in some spots but totally no where as bad as she claims
5pm, Times ran out.0 -
So were you subletting? Did the proper landlord know?0

Beginning to think this is Groundhog Day?
Or is it some weird new game ... how many times can I post the same lame excuses for my actions using different words to say virtually the same thing ... whilst totally ignoring any previous good advice given in replies ... and still not get any sympathy for my situation :rotfl:0 -
