Landlady not returing deposit

    plus £11.98 for some paint ( still think the very faint marks on the paint are wear and tear)

    Plus her time and fuel to collect and return it and do the job aswell. You admit to carpet being dirty, but now expect someone else to clean it , and getting shirty because they want you to pay, when you could have done it all yourself before you left.

    OK, so you hire the rugdoc and clean it yourself, touch up the paint and ask for your full deposit back OR you let her get it cleaned.

    The lodger no longer has any right to access the property or any right to demand access to carry out remedial works.

    The owner can permit access if they want (if the lodger has displayed the same attitude to them that they are displaying here, I would not be suprised to see that request denied - who knows how they're going to leave the carpet - it sounds like they wouldn't be trying overly hard to do it properly) OR they can employ a tradesperson to come in and do the job to a good standard (as the lodger should have done before they left).

    If the lodger feels agreived then they can take their case to small claims and both sides can put forward their evidence.
  • Surely it depends on what kind of paperwork you have...do you at least have proof that you paid the deposit? She should only take out what is reasonable to cover the cost of any work to return it to it's original state but you need proof of what the original state was (ie inventory when you moved in) and proof of the deposit that you paid. Without both you are largely at her mercy.

    Cleaning and touching up the paintwork and then asking her to inspect it before you moved out would have been the best way to ensure a speedy return of your deposit...hindsight is frustrating but at least it is a lesson learned.
  • all was well with her I left, on good talking terms when I left :D

    she then called the carpet "flithy" when I asked about my deposit 3 days later. :(

    Its not flithy as stated, its a 15 month old beige carpet that I bet one of those carpet cleaners would have like new in 30 minutes, no wear, just a little darker in places

    I called round to get some better photos, she was not in, but her other half let me in

    got the photos

    then got a unpleasant phone call soon afterwards off her.


    It was all smiley faces until I asked about my deposit 3 days later.

    inventory = nope

    contract = yes (hummm section 2.4 says "Yield the room at the end of the term in the same clean state and condition is was at the beginning of the term")

    seems make zero allowances for any wear and tear

    receipt = yes (same paper as contract)
