    ok.

    For next time, if there is no serial number on the outside box, would it be OK to open it and check the serial number. Then sell the item as brand new?

    I note that if the box is opened then we can't say that the box is sealed.

    The buyer didn't know that not all Amazon Marketplace Sellers can offer warranties. It only applies to authorised sellers including Amazon.co.uk.

    If you are selling something you have bought or won it is second hand as you have already owned it even if you have neither opened or used it. Brand new means little if an item is not being sold by a recognised retailer rather than an individual private seller. you are correct in that you cannot say it is still sealed. It may have an impact on what a buyer will pay but it brings some security to you as a seller to obtain the serial number and create an audit trail.

    You can of course describe it as unused and in as new condition.

    I didn't mention in the listing that I am offering warranty.

    So I didn't mislead him on that thing.

    His email was against me in all ways. (warranty + not geniune)

    Perhaps if you described it as brand new he assumed it would have the full warranty - he was not aware it was 4 years old and unused not brand new.

    I feel that he decided to return it after realizing he purchased an old generation. I am not sure. Could be.

    My understanding is that I listed the right item on the right page. I don't know if amazon is aware of that.

    I even made sure that the item model number was the same.

    Item model number: MB598ZO/A

    Its the same version. Amazon's claim is not right.

    I am presuming from this that you posted it in the New section and not in the Used. Apple have told him the screen has been replaced - therefore it cannot be described as Used. I would suggest you need to make a decision and stick with it. You can either accept Amazon's decision, get the Ipod back and decide what to do with it, or you can fight Amazon on it and in all probability lose. My advice would be to do what you need to do to put the whole thing to bed.

    Yes I did sell it in the new section as I haven't opened the box. It was brand new.

    I did really spend alot of energy on this problem. I will call it a strong lesson to me.

    I am hoping to resolve it with Amazon on Monday otherwise I will request the ipod back.
