You cannot prove he is lying - your word against his. Amazon do not need to involve themselves in checking if it is counterfeit. The packaging and the Ipod can both be validated by Apple and it is up to you to have it returned and get it checked.
If you are a regular Amazon seller it is in your best interest to get the item and get your name cleared, not waste time and energy accusing the buyer of lying - he may well be but you have to prove that.John0 -
If the item was genuine its likely that the buyer switched it for a counterfeit iPod. I suspect that is the one you will get back.
Is there a serial number on box, warranty card and Ipod? If so then buyer would have to have all the materials for counterfeit one. Possible of course.John0 -
Try posting on the auctions board about 20 boards down from this one...they are very knowledgeable...not that the guys here aren't...I'm going to stop digging this hole now!0

Buyer used the ipod and decided to return it after 1.5 months. I told him normally defective items should be returned within 14 days as per amazon rules but strangely amazon granted his claim.

here is everything:
buyer first email:
Hi, I had a problem with my laptop so took it with my ipod nano as I wanted to save all my music & pictures to my ipod from my laptop & the Apple engineer told me that he couldnt find the serial number for the ipod nano, that the screen had been replaced & its not a apple screen & the battery is playing up
I replied that he is trying to scam me and he is making false claims.
his 2nd email:
I'm not trying to scam you, the reason for the delay was because it was a Christmas present & with everything going on over Christmas & new year, the iPod wasn't used apart from charging it & turning it on to make sure it works & only reason I requested a return as Amazon had extended your returns because of Christmas to the 31st January so not to miss that date. If this is brand new like you say then there should be a year warranty on it
my 2nd and last reply to him:
You have received a brand new sealed box of Ipod. I should note that if the item is damaged or defective it should be reported to the Amazon Marketplace seller within 14 days (Thats in Amazon's Policy). Not after 1.5 months. The warranty you are talking about is made available to you if you make purchases from Amazon.co.uk and not from Amazon Marketplace Sellers. I have not mentioned in my listing that the ipod I was selling had a 1 year warranty. Also for your information, Amazon extended returns period until 31 January for purchases made from Amazon.co.uk and not Amazon Marketplace. Of course that's possible but its also possible the buyer is genuine - I am not going to assume anything.
A look at other postings from OP show that she purchased an item from Boots, used it and then found the same item cheaper from Wilkinsons. The OP purchased the cheaper item and asked MSE what they thought about returning the new item to Boots to obtain the refund of the higher priced item. I won't get into discussing how moral / immoral that was but only add it to this thread to show that anyone can be capable of some devious thinking to gain financially or materially.John0 -
reading the emails it doesn't sound like the buyer is trying to scam you. If he was going to scam you he would have done it straight away not 1.5 months later.

Always keep a note of serial numbers and email themk to buyer when you send the item out, creates a paper trail.0

2) I am not a usual seller on Amazon. Just occasionally I sell. I only have 14 ratings of 100%
3) It is indeed difficult to prove the buyer is lying. I am not selling on a regular basis. This will make amazon think twice about the condition of the items i am selling unfortunately.0 -

Boost may not have known the item was counterfeit - without the actual item and an audit trail to prove its the one send by Boost to you and sold by you then it may never be possible to prove anything

The best thing you can do to protect your integrity as a seller is to accept the judgement by Amazon, get the Ipod back and see if you can prove or disprove anything. Otherwise take it on the chin, after all the item was a prize so it cost you nothing. But it has taught you the need to keep comprehensive records when selling to avoid anyone cheating you
