    I'd still think that the contract is between the store and their manufacturer. if the manufacturer sent something to the customer different to what the store ordered then the store needs to take that up with the manufacturer not the customer.

    Another thing discovered in the original thread was that the owner had recently amended their T&C's to include customers receiving more than they had ordered lol
  • I have found the manufacturer? Do I contact them and explain what is happening and ask them to sort this out? Surely they have some responsibility if they are the ones who made this mistake regarding sending the wrong amount. Perhaps the trader and manufacturer can take it up between themselves. As far as I am concerned, I was told to keep the product free or charge because of the error and that's what I did. If the trader wants to claim losses for this, surely she should have taken it up with the manufacturer after realising her loss.

    Personally I wouldn't. It is between trader and manufacturer and anything else from the trader I think is just hot air.

    It's a risk the trader took when dropshipping.
  • Thanks. But as far as I am aware, the trader has not taken it up with the other company, she is bugging us instead.They may not be aware that she is demanding money from me. Perhaps if the manufacturer was aware of it, they would take it up with the trader. Surely its not good for business for customers to feel harassed over a mistake, especially after phoning the same day to ask for it to be rectified? Perhaps the manufacturers would be more professional and help deal with the problem.

    Just tell her to go do one (politely). Tell her you are keeping records of all her communications, and her failure to stop may lead to civil proceedings for harassment.

    DO NOT contact the manufacturer - you have no commercial arrangement with them at all.

    I see it like this, either the trader gave the manufacturer the wrong amounts or the manufacturer delivered the wrong amounts. You notified the trader of the mistake, was told it was OK to keep it and (I'm sure someone more informed can confirm or deny this) thereby accepting the price you paid, for the amount of item, as part of your contract.

    Either the trader needs to accept the error is theirs and pay the manufacturer the cost as a write off on their books or the manufacturer needs to accept the error is theirs and reduce the cost to the trader, becoming a write off for the manufacturer.

    ETA: Oh, and it was me who said I had a PDF of the traders posts should you need it.
  • Yes, your'e right. I will keep all details and shall ignore anything from her, which we have done since my husband ended her first call. It just seems so weird that she would be specific in saying we said 6 inches. I was next to my husband when she asked how much and he told her he was asking me. Very clearly, I stated that there was much too much material and I wanted to know what we had paid and he repeated this. It leaves you feeling sick when something like this happens. Never again will I accept a seller saying not to worry we can just 'gain' from their mistake.

    Google Alerts is how she probably found the thread, traders or individuals set up key words eg their business name and google alerts them when the key words are used.

    Google is also your friend...
