    One way would be send a PM to the two posters concerned and ask them to edit their posts.

    P.s. I would make sure you have copies of everything you need from this thread. I wouldn't be surprised to see this thread disappear too.
  • :rotfl: You didnt say you were a comedian. I have a feeling the closest this trader has ever been to a solicitor is watching Judge Judy.

    Unfortunately we do happen to be dealing with a solicitor regarding a council service injuring our daughter due to negligence. I know its a completely different case, but our solicitor has had to give very reasonable deadlines for the council to respond and they have missed the deadline 5 times and we are only now looking to pass this straight to court to issue stricter deadlines. Solicitors and those hiring solicitors have to be seen to give reasonable times to respond. I would be surprised if a solicitor would advise her to keep contacting me and giving deadlines of a couple of days.

    At least all the seller has to worry about regarding court cases is a bit of material which she probably has covered under insurance anyway.

    The seller would have got more competent advice on here than from her so-called solicitor.

    She would have received my husbands letter today and she has emailed me today. She says there is no way a judge would believe my 'story' and she is now accusing me of the following
    "This is the crime of attempting to obtain pecuniary advantage by deception."

    She's well and truly off her rocker. Just ignore her, let her file her claim if she's so convinced she's in the right.

    To prove any pecuniary advantage by deception she first needs to prove a deception, and as you have records of calling her to inform her of the deception I don't much fancy her chances.

    She's as barking as the dogs she makes beds for tbh.

    "pecuniary advantage by deception" was repealed in 2007 so the hot shot lawyer advising her is somewhat out of date... (I'm guess she's using Wiki & Wiki LLP)

    Deception? Like sneaking in a contract term that favours the seller, and then trying to make the OP believe that they are legally bound to abide to a term that was added after the conclusion of the contract by acting as if it had always been in place?
    For pecuniary advantage, like doing the above so as not to have to pay to cover a mistake by either the seller or manufacturer?


    Just saying.

    Moot point, as its been repealed, but y'know...
