Are these DVDs fake?

Had some American TV series DVDs bought for me for Christmas and have only just got about to opening them.
Upon opening them and i had suspicions they were/are fake.
I put them in my pc (no autostart) and read them with anydvd. (they are region 1)
They are Sony dvd's but Anydvd says they have no region encoding and no copy protection, and are also single layer disks (very un-sony)
I told the purchaser and was informed they were purchased through ebay from a power seller. but 45 days has elapsed since purchase so not sure what can be done.
Can anyone offer advice on definitive way to tell if fake and what to do regarding getting money back.

The person who bought them would need to do any small claims action, you are too late for either of you to go through ebay/paypal.

That doesn't seem right, surely for pirated dvd's where there is some level of production (printed disks, sleeves etc) there would be a special dispensation even after 45 days.
My brother has messaged the seller but no response yet...
There is a piracy warning at the beginning with some contact info, may have to contact them and possibly Sony

If you are suggesting doing something which contravenes policy then I would advise strongly against it.
You are over the 45 days, but if your brother (I assume it is he who bought them) wishes to pursue it with his cardholder (if he funded the payment that way) then he *may be able to chargeback the initial amount.
Have you heard back from the seller? Perhaps ring them to find out what is what.0 -

To your first point, yes, very serious. You could have yours, your brothers and everyone in those two (if it is two) households paypal and ebay accounts closed.
To your second point. Where did I say it was ok? Just because it isn't what you want to hear don't throw your toys out of the pram.
I gave you another option, which is relatively easy if the cardholder can get the card provider to comply. The other option is legal action.0 -

I will simply be reporting this seller to the proper authorities that deal with dvd piracy.
