wife crashed, and i was hurt.

hi,back in october my wife went into the back of another car i was the passenger(husband) clearly her fault, i at the time felt ok but the next day lower back was giving me some pain i just took pain killers and thought nothing of it ,after a few weeks my back was back to normal,when the wife rang her insurers to report the accident one of the questions were anyone hurt her reply no, the thing is today she gets a call from a company called more blatch resolve to discuss the accident she had in october and one of the questions was anyone hurt, she said my husbands back they then said to her your husband could claim for his back from your insurers which at this point she passed the phone to me to discuss the claim i said to them will this effect her insurance if i put in a claim which they then said no,what i want to know surely if i claim she will be penalised as she will have to declare upon renewal someone was injured she is no longer with the insurance company am i best just to leave it and tell them i dont want to proceed . any help in this field would be appreciated.
Are we living or just existing !

She already has a claim on her record over the incident. Any PI claim now will still be part of that one claim, which she will already have disclosed to her current insurer (or should have done!)
Injury claims can be made up to 3 years from the incident, so this isn't unusual.0 -

I'm not an underwriter, but I'd guess it could be a ratings factor for future quotes because when you get a quote and disclose a previous claim, you are often asked if you know the cost of the claim made and if there was injury.
At a guess, I'd wager that would be a ratings factor as an increased perceived risk for the cost of any future claims, so a good chance of a higher premium.
You'd have to play about with dummy quotes on price comparison sites to see if there was a difference though.
As for your possible injury claim, the only bother I can see arising with your wife's insurers will be that they will get a bit excited on seeing the injury claim appear when your wife said nobody was injured. So there could be a little bit of resistance initially.
Moore Blatch are solicitors, who have probably bought some data about the accident from somewhere as I can't see your wife's insurers putting them onto you to then invite a claim against them.
At the same time, if it is Moore Blatch Solicitors cold calling people out of the blue, that is a breach of many serious regulations as solicitors are not allowed to cold call people and aren't supposed to take on cases where clients were cold called by a company in the first place.0 -

I'd go for where there is injury as a result of negligence there should be compensation.
Granted three weeks is fairly short in injury duration but this will obviously be reflected in the OP's medical records from the time and thus will feed through to any settlement.0 -

I got calls for months and months from companies saying I should claim for injuries sustained in my recent claim.
Ha, I wasnt even in the car.
Dont touch these companies who cold call, they are leeches.
If you are okay, just get on with your life.
If your wife told the insurance company that there were no injuries they are naturally going to be suspicious.
So you had a bit of back ache, so what.make the most of it, we are only here for the weekend.

Well... "we" don't "all" moan, and if you are hit by some negligent third party then they should pay up for their actions.
People are entitled to come and ask for advice here.

The wife told them there were no injuries (apparent) at the time of the incident.
As injuries (esp whiplash) take time to develop, this won't cause "suspicion" now, and the liable insurer will make checks to ensure the claim is genuine no matter what the circs!
