Rejection of car due to paint

I purchase a Vauxhall Meriva from a main Vauxhall dealer and collected the car two weeks ago.

On the day of inspection and collection it was raining and I did not notice anything wrong with the conditions of the cars bodywork of note.

Once the wet weather has ceased, I have found that the front bumper is mis-aligned and the paint is a different shade and dull.

I have asked for the car to be exchanged under the Network Q 30 day exchange programme, alternatively I have said I will have to reject the car.

They have advised because I did not notice the issue on inspection then I have no write to reject or exchange.

What are peoples thoughts as I did not pay £7400 on a two tone car!!

    We're confident you'll be absolutely thrilled with your purchase. But, for added peace of mind, if your car develops a mechanical or electrical fault (in the first 30 days of ownership) that cannot be repaired to a satisfactory standard, the supplying retailer will exchange it for a Network Q vehicle of equal value.

    That's the 30 day exchange policy.

    You could argue however that the 'Network Q Multipoint Check' they do wasn't thorough enough as it didn't pick up that issue

Simply because we believe in our cars, believe in their inherent quality and hold our customers' satisfaction paramount.

    Unfortunately i dont see it as terms for rejection either.

    It should however have been inspected under the terms of the Network Q programme, so you would be expecting them to rectify it under that.

    Obtain a opinion of a crash repairer, sounds like the vehicle has been involved in a collision.
    If this is the case, get a copy of the report and write a Notice of rejection and serve it by hand at the dealership taking evidence on a camera phone or similar.
    Then you will need to give them time to respond and then start a SOG claim.

  • The dealer is in Croydon and we are in Swindon, so not possible to deliver by hand, but I have issued then with an email and images advising of my intention to reject if not covered under 30 day programme.

    I am awaiting a response from the used car sales manager, but the initial call from the salesman wasn't positive.

    e-mail can be completely ignored from a Legal prospective and will be.

    Use first class post and obtain proof of posting (obviously keep a copy).

    Matters not it does not count as a served document.
    If you want to find a solution to this you are going to have to break some eggs to make your omelet.
    You need a stick first : that is a report from an experienced repairer on the paint.
    Then you need to SERVE a notice of rejection, by hand is best or as said recorded delivery post will do .

    The dealer will just fob you off until you move in to a position on the board that threatens theirs.

    If you want to reject the car then you may have to make that 100 mile ish? journey possible.

    You will need to make the journey to return it anyway. But you may also need to offer them the chance of utting any defects right.

    Its not their fault you live so far away. Did you think about that distance when taking it back for repairs and warranty work etc?

    Email although convenient is not reliable.

    As they are a main dealer and you purchased the car under their approved used scheme contact Vauxhall customer services and make a complaint to them.
