Yet another Vodafone Issue

Hi All

Happy New Year and Best Wishes for 2013 to you all.

Have been on Vf for few months, they are worse than useless for service. I continually:
- Cannot get service to make or receive calls, have to have calls diverted. This is both at home and in alot of areas in and around London.
- Texts are not sending immediately, even when I have service, they take up to 5 minutes and others tell me that even though my phone says despatched they do not receive them.
- In Nov I left my previous full time address and moved into my current one in Dec, I lived at 2 addresses in between. Of them 4 addresses I got service at none of them. Even though there coverage checker shows good service at all of them.
- Have asked for suresignal and they want me to pay £50 and I am not going to pay for a service they should be providing anyway
- Have had number of issues with there customer service team but not sure they are relevant.

Have emailed CEO Office and they will do nothing as they said only 2% of my outgoing calls were affected, they cannot test incoming calls or texts - convenient! How can they tell, cos this is not correct I have had numerous failed calls that either do not connect or when they do the connection is so poor I have had to redial again and again sometimes. In the end I have given up using the phone unless I have 3 bars and have had to get a PAYG to use.

CEO office has given me PAC, that if I use I will have to pay remainder of contract.

I want to issue proceedings for breach of contract, my questions are:
1. Can I use MCOL for this.
2. Can I use PAC in meantime and issue proceedings.
3. If I do use the PAC and do not issue and do not pay the money what will Vf do, assume they will put on my Credit file and use debt collection agency, if so can I then request that they issue proceedings so I have chance to defend.

Sorry that it is so long winded but really wanted to put everything I can and really do need some help and advice please.

    1/ yes
    2/ yes
    3/ Yes they will and no you won't be able to force them to issue proceedings to mount a defence ...if you want a day in court you will have to issue.

    In fairness to Vodafone you are either very unlucky to not get a signal at 4 different addresses and the fact they show a signal on the checker would lead you to suspect the problem may be elsewhere.

    Have you tried a different phone or sim ????

    Convienent but true for Texts. SMS was not really designed as a messaging system in the way we use it, but more a way to get simple messages to all users.

    Texts have no time priority, they can be delayed/lost (think new years eve) if the system is busy, and cannot process them all at once. Texts usually have a 3 day validity, if they haven't got to the destination by three days they get deleted.

    That said thats not quite the case you have here, did you check all the settings were correct? It can happen if you have a phone you used to use on another network that the message centre settings are wrong so text are sent from your phone, and hence why it looks like they have gone, but as they never get to the networks message centre never get forwarded on.

    Unfortunatly as you moved then you have a limited case.

    I appreciate there will be other circumstances, and checking signal stength is not on the list of anyones move criteria but it's not vodafone fault that you moved house, unless you specified your current address as it had to work at the time you took the contract out then vodafone have no responsibility to provide a service there.

    Sorry thats probably not what you want to hear, but no network guarantees service at all locations at all times.

    My point was that Vf have a contract with me to provide a service, which by their own admission they are not which is why they offered to sell me a suresignal. At the very least if their service is so poor they should surely provide the box for free.

    When I get paid I think I will use the PAC and issue on MCOL and take the risk as I'm pretty confident that I can win, I'll show the Court this:

    Phone signal is not guaranteed by any mobile operator.

    If you're confident that you'll win, why are you here and not on MCOL filling out the forms?

    You are likely to lose and get a trashed credit record.

    Search the web and find lots of successful claims against the networks to give you confidence, However, if you can't find lots, it should tell you something.

    You are set on a course that will cause you even more grief, I fear.

    If I lost, planned to just pay the money so not sure how my credit report would be trashed. My understanding is (well, was!) that if I issue they cannot put defaults on my credit report during the process and then if I do lose and pay straight away there are no adverse marks, is this not correct?

    It's to do with the timeline. As long as you pay the cancellation charge and all outstanding bills then go to MCOL, you will have no problem. It's if you don't pay and try to claim for monthly charges already paid to date that you would have trouble.

    Remember that Vodafone may be able produce evidence that other people in your area have a service, can supply MCOL with how many people that may be as well, how it may very well be your hardware that is the problem, not the service.

    Have you checked that no other of your friends on Vodafone have that problem in your house? Is there no place that the handset works perfectly? Can you show it misperforming in a Vodafone shop?
