Thank you, I have looked at 108 above but not really understand what I am reading or what it means!! I am not to good with these types of issues.......

I can't seem to find out how to go about a complaint as I am not complaining about the MOJ am I?

I have now contacted my credit card company and now awaiting a questionaire to fill in. I have also reported it to Action Fraud who have made a report. Nothing seems overly positive at the moment though, Is there anything else I can or should do now? apart from be more diligent in future.
    Regards......

Raise an immediate chargeback with your Credit Card company and also report this company to Action Fraud.

They could also be in trouble if they have directly called you. See post 108 above. So please also complain to the MoJ - here

'Chargebacks' don't apply to credit cards, section 75 of CCA does.

Also as Ifonic surrendered their MOJ authorization, complaining to MOJ is pointless as the company no longer comes under their jurisdiction.

When did Ifonic first contact you and when did they take the payment?
  • It was originaly with Getclaiming and that was in February then they were supposed to have been taken over by Ifonic in April.
  • Ifonic plc ! Yes my partner has been HAD by these people .. after many colds calls he was convinced to hand over his card details. My partner told them he was made bankrupt 10 years ago and that he wasn't dew any money and if he did get any it would go in to insolvency, but was assured that this wasn't the case. So he handed over £600 plus £10 for each bank which was contacted. This all started in march 2013.....since then we have revived £112.59p we were assured that the mis-sold PPI claims would total over £10,000 !!!...six claims were made and 3 offers received 2 of which went to insolvency as we said they would !!!! They now want there 22% of that cash which we never got . We have written to them ... and are sourcing advice from the C.A.B ...We are getting nasty bullying calls from them every month or so from a very unpleasant women who is "Trying to help us" with a payment plan !!! WE HAVE BEEN HAD .... they are now taking US to court

Let them take you to court. Read through this thread, point out relevant information to the court and get further advice from CAB.

A blatent lie by the claims company and a breach of their code of conduct agreed with the ministry of justice.
They now want there 22% of that cash which we never got .

Which is why people with arrears, defaults, amounts written off/bankruptcy etc should never use claims companies and those claims companies are meant to warn of such things like this.

Send a complaint to the ministry of justice stating what you have here.

    https://www.gov.uk/complain-about-claims-company

If they attempt to take you to court then you can respond to the court papers saying that you are in dispute with the company over misrepresentation and breach of ministry of justice rules and that the ministry of justice are investigating the complaint. The court will not hear the case whilst your complaint is being dealt with

A alot of the dodgy ones will threaten court and huff and puff to scare you but never follow through as they know full well that the court will not side with them once they hear the full story. They try to scare people into paying. However, you must complain to the MoJ to get the complaint registered.
