Flight Delay Compensation, Lufthansa Only

I have a problem with Condor, I believe the parent is Lufthansa hence posting in this thread. Flight delayed, emailed them, was offered some compensation on 23rd September (600 euros). I queried the time they quoted as arrival as they were 4 minutes out from being over the 4 hour threshold, and i had evidence from Flight Aware the arrival time was later than what their reply stated.
I don't understand what you were trying to achieve here - the compensation is a fixed amount that is payable if delayed beyond three hours, but there's no more available for a four hour delay, so it's not an 'offer' subject to negotiation, you're either entitled to it or not.

This cuts both ways of course, so if it's due then the airline has no right to decline to pay it, so it will indeed come down to their rationale for rejecting your claim now.  If you've treated their response as being final and gone to ADR then yes, all you can do now is to let that take its course.
The flight was over 3500km so there would have been more compensation due for a delay of over 4 hours, no? Unless I have got that bit wrong. Truth be told I would have accepted the compensation which was offered, but husband wanted me to argue the toss over the extra few minutes and now we're in this situation.

I sent my case to ADR before I had received the newest reply, as I had been waiting so long (and sent further emails to them in the meantime via Resolver) and thought I was just getting ignored.

If I reply to Condor asking for the reason behind their rationale, do they have to give it or can they decline to do so?

No, the compensation is the same amount for any delay over three hours, so you do have that wrong.

There's no obligation for them to enter into any discussion but there's no harm in asking.  However, if you've kicked off the ADR process then they'll have to give their justification to that, so you should find out via that route eventually....

Great, I'll just hold tight then, thanks.
  • Ah, I just notice the ADR have got in touch with me today. I've updated them and will leave it with them for now.
    Thanks again.

For the avoidance of doubt, Condor are not part of Lufthansa, indeed they are at loggerheads right now as Lufthansa used to offer discounted connecting flights for Condor and announced they were ending them as a result of which Condor has had to launch a new series of domestic flights to connect with their long haul operations. A great pity you turned down the maximum compensation payable which appears to have given them the opportunity to review the file and see you may have only been entitled to half.
  • Useful to know Alan, thank you.

I realised I forgot to say the compensation I was offered (600 euro) was the total I was offered for 2 pax not for one hence why I thought I was entitled to more for a dekay upwards of 4 hours over a long distance.

Just to be clear, was your flight delayed or was it cancelled and you were offered seats on another one?  If the former then the duration of the delay (once over three hours) is irrelevant, but the arrival time of a replacement flight may be significant in the latter scenario....

Original flight delayed meaning a missed connection (all booked through Condor but one part of the journey with Condor and one with Lufthansa) and then not offered seats on the next flight out leading to the delayed arrival time at the other end.

And again for clarity, were the flights bought as through bookings from end to end on one ticket, with baggage checked all the way through for example, rather than 'self connect'?

    Yeo that is absolutely correct
