  • Similar issue here: I bought 6 CDs in two separate orders from HMV the day before Administration. On the 15th I got despatch confirmation emails for each of them, but none have arrived.

    I don't think it's a weather issue because I bought other CDs from Play and Amazon at the same time with no problem.

    I may be too cynical but what makes me suspicious is that the despatch emails came very quickly the next day, which in my experience is unusual. Could it be that HMV was sending despatch emails merely to trigger payment, without physically sending out any CDs?

    I'm awaiting a response from Deloitte, but the difficulty here is that if a despatch email has been sent, the matter (as far as banks and chargeback are concerned) may be dismissed as a Royal Mail issue, which is something that the sender of the goods has to ultimately claim for.

    I'd be grateful if anyone else who's had this problem could add to this thread so we can get an idea of how common it may be.

    Same thing happened to me. Ordered a CD on the 13th, despatch email on the 14th, nothing in the post as yet.

  • i posted an unwanted xmas gift back just before hmv went into administration. i received no refund. called the administrators and the lady said i should be eligible for a refund because returned before administration and that she would call back next week. she didn't. then we couldn't get through. then the next person my husband spoke to clearly had no idea what they were talking about.

    so i am just wondering what the legalities are here. basically i have returned when i was within my rights to, but it is something for which i have not been refunded. they have the item and my money. what should i do? it isn't over £100 so can't get help from credit card company. i feel like the administrators are just mucking us around.
  • i forgot to mention that i returned it on 7th jan so they would have received it on 10th or 11th latest.

    Like a few others I ordered a cd online on Sun 13/1, had a dispatched email on Mon before it hit the news mon evening so thought I would probably get it but it never showed. It was only £7 so i've not lost much and doubt i'll get it back (paid Mastercard so don't think from what i've read I can get it back from them as it's not over £10) but if anyone gets a refund please post and let us now how you did it!

    we did the same with a duplicate christmas gift (sent it back between christmas and New Year). Today we got an email from the administrator telling us we were an unsecured creditor and had to put in a claim.

    Wish we'd not bothered sending the goods back now and ebayed it to at least get something back.

  • Update on my missing CDs (ordered the day before administration, apparently despatched, money taken from account):

    29 Jan - Had an email reply from HMV/Deloitte to say all orders paid for just prior to Deloitte's appointment would be delivered over the next 5 working days;

    31 Jan - Had another email (unprompted) from them saying that I'd returned items to them for a refund but because they couldn't give refunds the items were being returned to me. That doesn't match my situation at all, so I'll presume it's been sent to me in error. (They also advised me to fill in a creditor's claim form.)

    They do seem to be giving the impression of not being sure of what they're doing, or trying to buy themselves more time.

    As far as I can tell from elsewhere on the net, people who bought and paid for stuff in mid-Jan are still awaiting delivery.

    My CD ordered 13/1, dispatch email 14/1 has arrived today so they do appear to be sending them out now. Not sure what to do with it because I had to order a replacement so don't need it now.
  • Happy to report that 5 of the 6 CDs I ordered (despatch email dated 14 Jan) finally arrived this morning.

    Hope people in the same boat here are receiving theirs too.
