Dear Laura
Following my call to you earlier this week, I have sought advice in regard to your letter to my Father reference a 'Charge Notice' issued in relation to my driving / parking.
Please be advised:- I am writing to Highview parking, (the issuer of said noticexxxxxxxxxx currently and dispute it's validity. What they have issued is an ‘unenforceable speculative invoice.’
- As per the lease Terms and Conditions in Hire Agreement xxxxxxxxx, at
- 8. STATUTORY REQUIREMENTS States;
(b) 'You will pay to us any charges penalties or fines under the Road Traffic Act 1974 or any similar Act for which a Summons (or that which supersedes it) may be made against the Vehicle or us in respect of a fixed penalty notice or an excess charge or any other breach of the Law arising out of use of the Vehicle during the Term. In the event we are required for whatever reason to pay such charges fines or penalties then you shall on demand reimburse us for all such amounts together with a reasonable administration charge which we will tell you from time to time.’
Consequently, I would advise that this is not a valid charge, penalty or fine or Summons as per any Act nor is it a breach of any law. It has no validity; you have no obligation or right to pay it on my behalf.
Additionally, no administration charge is payable by my father for the reasons stated. 8 (b) is relating to administration charges where you are required to pay. For clarity, you are NOT required to pay this company, 'Highview Parking' NOR are you entitled to charge my father £12 plus VAT or any other amount in relation to this.
For clarity, you must not pay Highview under any circumstances, for if you do, neither I nor my father will be liable for the error in paying an unenforceable speculative invoice.0 -

That looks fine for the Lease co. But URGENTLY hook Highview's letters in your direction, any old appeal would do, then ignore the scam like we all do!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Don't let them weasel their way out of the conditions you quoted above regarding their terms and conditions.
This isn't a fine, nor a penalty, nor was it issued under the Road Traffic Act, nor any other breach of the law, nor are they required to pay it.

Ask them exactly why they need to discuss it with your father. I can only guess they will try to browbeat him into accepting liability for the parking charge and/or their admin charge. Don't let that happen.
While you're at it, ask they why they seem so confused over private parking notices, considering they, as a lease company, must come across these quite frequently. If they don't understand the difference between them and a real parking ticket, they should really be consulting their own trade association, or possibly a job agency, as they are clearly not doing their job.0 -
I replied that there was no need to contact my father and that I had written with the details, his agreement number, registration etc and that there was no need for discussion. If they choose to acknowledge my letter in writing to either me or my father that it would be their choice and cost. They are not required to act further in relation to a speculative invoice which is unenforceable and should simply be discarded (or filed if they wish).
Will update anything further. Dad's concerned they will send him repeat letters and charge him for them.0 -

Calls to Leasing company, letters to Highview, Lease company and manager at PC World, Livi
Highview replied-summary=signage compliant, notice issued correctly, reduce to £50 if pd in 14 days. I'm happy to ignore them but...
Leasing company replied-summary=If appeal is successful, will be able to credit admin fee charged to Dad's account.
Parking companies not governed by statutory law but are under Civil Law, trespassing or contractual breach.
Quotes re. trespass law, owner entitled to receive reasonable compensation or damages(fines)
Quotes re. Contractual Breach, Implied acceptance if driving into car park. Contract then formed and can be breached.
Providing appropriate and clear signage was about the car park, we have to treat this fine legitimately.
On a final note, we treat parking issued notices with the same integrity as fines issued by councils.
Where do I go with this one, I am happy to ignore highview now they have my name and not my Dad's but can I expect to convince the leasing company to drop their admin fee or should I pay it so my Dad doesn't need t0 -

We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
