Get a copy of the lease agreement and see exactly under what conditions they can levy an admin charge.
I'm willing to bet it only covers fines and penalties issued by an authority under traffic legislation (or similar), which of course this ticket isn't in any way, shape, or form.
Post it up here if you want advice.Je Suis Cecil.0 -
ok, will check Dad's lease, he's worried about it not getting paid.
Thanks all0 -
You need to contact Highview 'you think'? But we told you that already. Thought you would have done so first thing.
Read the advice you got. You need to contact Highview NOW. FIRST. There must be a method of contact on the fake PCN, or at least an online appeals system, use it to say you were driving, give your name/address and any appeal you like (just don't draw their attention to this being a leased car or they may try it on again with another letter to the lease co even though that is against the law once they know who was driving).
The whole idea is to urgently hook the PPC in your direction for all future letters. Before you do anything else.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

And it wouldn't hurt to copy it to the leasing company too, reminding them that under the recent legislation their only obligation is to notify the PPC of who the hirer was. That gets them off any hook.0 -
Coupon-Mad, the notice has only a PO BOX address on it, that's why I contacted the leasing company first, they have a telephone number, named person and dept to deal wiyh 'fines and notices' on their letter sent enclosing the charge notice from Highview.
Guys Dad- the recent legislation is quoted in their charge notice but it doesn't apply in Scotland anyway. The leasing company are based in England though, I'm guessing that's why the leasing company would have passed on their charge notice to my Dad.
I am now doing a letter to Highview and will copy it to leasing company.0 -
Let us know what it says in the Lease regarding parking tickets and admin fees and we can help with your letter.Je Suis Cecil.0

Ok, tried to post a photo of the clause, not allowed cause I'm too new, bear with me, I'll type it out..........
'You will pay to us any charges penalties or fines under the Road Traffic Act 1974 or any similar Act for which a Summons (or that which supersedes it) may be made against the Vehicle or us in respect of a fixed penalty notice or an excess charge or any other breach of the Law arising out of use of the Vehicle during the Term. In the event we are required for whatever reason to pay such charges fines or penalties then you shall on demand reimburse us for all such amounts together with a reasonable administration charge which we will tell you from time to time.'0 -

Private Parking "tickets" are not covered by RTA 1974 or any other "similar" act. You should make very clear to the lease company that they pay it at their own cost and any charge they attempt to take will be raised with the credit card issuer to get a refund. All aboard the Gus Bus !0 -
