    Our claim is for 6 people - 4 adults that were on one booking reference and 2 children who were on another booking reference. We are now awaiting mediation / court date. At no point have we been told we can't claim for more than 1 person....................

    Do you mean multiple claimants on a single claim as opposed to one person as claimant making a claim "on behalf of" others? The former seems to be the accepted way, the latter (I think) is less clear.

  • I decided to use a no win no fee company called airline recovery they just seem to do nothing just send letters never taking them to court which I go as far as that and thought I'd used them. So I have spoke to eu claims who don't do claims back as far as 2008. So I have now paid the small claims court online to act. Virgin just don't want any of it. Saying couldn't keep part at every airport. Has anyone won this case vs0052 from Tobago to Gatwick on 20/11/08 24 hour delay!

    I have received the response that can only claim for myself not the rest of my party of 6 even though we were on the same booking reference. I am at the same stage awaiting a court date hopefully at my local court, going to read through the threads but if I win then would expect a payment for everyone if not I will just take them to court again. Fingers crossed we all win they are trying their hardest to defend this flight obviously due to the 250 claims they have received. Good luck with your claim, looks like they are going to have quite a few court cases:(

    For that flight but originating in Grenada I have mediation scheduled for 17th Oct and court hearing on 15th Nov......
  • Hello, I wonder if some of the experts on this thread could advise me as to wether I have a case to pursue? 8 of us were delayed on a Vegas to gatwick flight on 22/06/12. Total delay was 5 and a half hours so we have followed the guidelines here to make a claim. Virgin have claimed EC due to a fault with the flight planning system which started on 22/06/12 and resulted in the the operations department having to manually file flight plans which caused delays to flights. They go on to say that the flight planning system is operated externally by a 3rd party based in Vienna. As this wasn't a technical problem with the plane I'm starting to doubt that we have a claim. What do you think?

I was planning on using Centipede100's NBA template. I was going to send it tomorrow (06/09/2013) giving until 21/09/2013 to reply. If I don't hear back I'll then raise a claim through MCOL on 22/09/2013. Do these timelines sound ok?

    Hi all,

    I raised my MCOL as per above. Initially I received an acknowledgement of Service a few days ago. However in today's post I have received a letter as below and a cheque for £535 (I claimed £500 on MCOL (600 euros) plus £35 court fee).

    "I was concerned to hear that you've brought a claim against us regarding your delayed flight from New York. Obviously, we hate to end up in this situation with our customers, and I'm sorry that you felt upset enough about this to bring a legal claim.

    We see no value in disputes of this nature with our passengers and would therefore like to settle it for you. In this respect, I have pleasure in enclosing a cheque for £535.00. This is in full and final settlement of your claim against us, and I would be grateful for confirmation that you have withdrawn your claim from the County Court.

    I'm sorry once again that things have come to this, and I'm please we have been able to settle this amicably"

    I wasn't aware that airlines depended on 3rd parties for flight planning but this doesn't sound extraordinary in any sense. I would have thought Virgin should be entitled to make a claim against the company in Vienna which would mean they weren't bearing the cost of compensation to delayed passengers.

    Virgin appear to claim EC half the time and pay up straightaway the rest of the time (see JonHeath's posting above) - seemingly irrespective of the circumstances.

    If you want to claim what you should be entitled to, you need to start doing some research (all you need to know on here) and decide whether to take action yourself or engage a no win-no fee solicitor.
