True, so I have just made a request to HM Courts & Tribunal Service! I have no idea what information they have and what they ar allowed to disclose but I'll obviously report back when a response is received!0 -
Jet2 have no obligation to provide that information so a Freedom of Information request will go unheard.
I'd guess they are having the most success because they are using the best barristers - guys who have taken the time to examine the regulations and break them down, line by line.0 -

There was a post on here this morning saying that Bird & Bird had settled out of court in his/her case, it looks as though the post has dissapeared - thought it had been moved to the SUCCESS thread, but can't find it there either?!?!?

His Honour Judge Platts has actually read and understood the law. Big thanks owed to Ronald Huz for having the tenacity to appeal - and to the legal team at Bott & Co..
The quotes from Jet2 in the Independent are unsurprisingly disingenuous :

So does this mean I can appeal the unlawful decision the judge gave in my case?

From reading the article it appears that the appeal was heard in a County Court so the judgment is not binding, ie no precedent has been set
That said, chances are that all of the District Judges in the North West will be paying a bit more attention to Wallentin in future
It really is a fairly specific Judgment which doesn't leave too much open to interpretation. If some DJ's around the country insist on constantly misinterpreting it, it's only a matter of time before the applicable Circuit Judge throws it back in their face :cool:0
